This is one way to get around the WARN act. This is how it has happened in the past:
Rather than give employees 60 day notice, NetApp changes their working status. Come RIF day, those lucky souls affected will be notified that they are still technically employed by NetApp for the next 60 ish dsys, but their status is something like "Not Working.". They are not allowed to work, but they will still receive full paychecks and benefits.
After the 60 ish days are up, they will then become officially unemployed. They will receive their severance checks, which will vary based on their position, vacation acrual and tenure etc. I think it was something like 3 weeks pay plus an additional week for every year served, up to a max of 12 weeks pay.
Not much solice if you're on the list, but if you get cut in November you'll actually still be employed with benefits through the first week of January. Merry Christmas from George Kurian.
