Got laid off on 29th march 2017 from WD (DCS, HGST). Severance is good, 2 months of WARN pay and then one week of pay for every year of service (min 4 weeks). 2 months of COBRA pay and 100% STI payment. One way ticket to your home country if you are on work VISA.

wd had paid 800 million to Seagate due to lawsuit loss, but is there any successful story of its lawsuit loss to its own employees?

I am also not a lawyer, but from the little I know, you cannot sue for 2 reasons:

  1. Arbitrating Agreement safeguards the company from such lawsuits as you need to first go thro Arbitrator.

  2. I think, the reason the company came up with "Unlimited Vacation" is to ensure that it does not deal with these nuisance complaints, and they are not obligated to pay for "unused" vacation time for employees who are to be laid off. This saves the company a lot of money by way of payouts during layoff time.

Are you classified as an exempt or non-exempt employee under California Law? http://www.calchamber.com/california-employment-law/pages/exempt-nonexempt-employees.aspx

Also, you may be prevented from suing the company under the conditions outlined in the severance plan/agreement.
