Filing for unemployment in California

I was laid off in December in San Ramon and iam now planning to file for unemployment. Any tips from folks who have gone through the filing process in CA ?, does getting a Severance or the Expression of interest have any impact on qualifying for Benefits Thanks

You are not out of compliance with any of the rules of UI benefits simply because you take a vacation. However, you are out of compliance with being literate when you cannot spell "leech" - LOL!

-1ekz, I took one, in the states. Make sure you file every Sunday. Also keep those contacts flowing by going to those sites. Or use personal ones. You can file anywhere you can get online. In the CalJOBS thing I saw a virtual recruiter. I am not sure if it works like ours. With ours, they made you do all that - Online Resume, and Virtual recruiter, etc. to qualify for benefits and helped you set it up when you went in. You are basically at their command. If you plan on getting your benefits, plan on obeying all the rules to the gnats a--. It's not that bad, no worse than chip-dip!!

-1yco, I don't know of any state which requires interviews or even applying for a job at all. Correct me if I am wrong, someone. I have received all of my benefits in LA. The only requirement is to list 3 or more CONTACTS which were made each week. I needed to list the contact and the date. It can be online. I.e. - making an online contact with any company, recruiter, etc. There is no requirement to actually APPLY for the job. After all, you may not be anywhere near qualified or able to travel to the location. Also, there is a virtual recruiter on the state Unemployment website which sends you a list of positions/companies in your message box daily that you can contact and use easily. Once you open that message and click on that job, visit the website, it automatically populates the field in your "file for weekly benefits" online form so you don't even have to fill it in. You just need to keep your virtual recruiter and resume up to date and update it again after a couple of months, it expires. After a few weeks, it is like clockwork. No worries, mate.

Also - most states now require you to show up for a couple of visits to that office. They are making sure that you are legit and showing you that online program that they have and other job-seeking programs. IT's called REA (re-employment assistance?) government grant funded. Just show up, answer questions. No big deal. At most, they will only remove one testi--- (LOL- just kidding).

What is the process to follow in CA to continue to receive benefits ?, how many companies do you have to interview with every two weeks , difficult to find interviews for comparable jobs

-1ahw, I believe is correct. A layoff is a layoff, although, in "intent" is not what the UI system has in mind when the question is posed of whether you were departed from employment on your own accord. I do believe, though that the "EOI" request option for Chevron can still be considered technically being laid off and subject to UI compensation per state requirements and within all verifiable requirements, since to them, a layoff is a layoff. You are not technically eligible if you quit or were fired. However, It is veritably not the Department of Labor's intention to reward benefits to people who in a roundabout way, intentionally left or "requested EOI/to be laid off". That is effectively quitting but, is somewhat of a "loophole" to still being eligible for UI benefits, since it is not documented as quitting.

@1usv, a layoff is not the same as quitting your job. Quitting (in most cases) will disqualify you from getting unemployment benefits, whereas getting laid off won't disqualify you. The Espression of Interest (EOI) is not quitting. Chevron will place you in the category of laid off workers after "raising your hand". So, don't worry about that being punitive. You will qualify for UI benefits, no matter which state you live in.

You are so right @IMCr9Oj-1uyb. You need to look at the economics and the time value of money. Every day that you do not have that money in your savings account or stocks getting returns, interest, dividends, etc., is money that you are missing out on. Even the IRS gives you the interest back on your tax returns. At least our state does. Think about it.

Yes, I agree 100%... file for benefits right away. Don't put it off. Everyday you are unemployed is a day you should be collecting what is due to you. Some say they don't need to collect benefits until later because they have savings. I say... Collect it now and save it if you don't need it right away.

First, I would recommend to take all your money from banks, stocks, pension funds, savings etc to cash it, because soon all banks will collapse and you won't have a chance to take more than $25 per day from ATMs. All groceries will be empty, and a lot of criminal gangs with guns on the streets. You won't have much time, please listen to me, and you will be grateful to me all your life, stupid morons...

Yes, I agree with that getting your UI benefits as soon as possible is the best route. That's what I did and I immediately put it into my brokerage account and have been earning seriously coin as we adjust to living off one income and I look for a job. I am a saver, not a spender. It's nice that the stock market has picked up a little, thanks to Trump doing better and giving the country hope for being great again.

@IMCr9Oj-1zma, That is not a bad policy, to avoid procrastination, but of course, you must know, that the total available benefit does not change if you begin your payments at a later date. In normal times (non-high unemployment, emergency, etc) the benefit is 26 weeks, no matter when you start.

My advise is always... file for UI benefits on Day 1. Don't put it off. Everyday you are unemployed is a day you should be collecting what is due to you. Some say they don't need to collect benefits until later because they have savings. I say... Collect it now and save it if you don't need it right away.

I do not think that there is any requirement that you have to file soon. I filed a couple of months after with no problem. In fact it is better as the severance issue goes away. I think it's as long as you get the required quota of wages in within the previous 5 quarters. And I think they only use something like 3 quarters. I could be wrong. In my state a claim today would be based on the base period of April 1, 2015 to March 31 2016 and you need either 20 weeks or $8400 wages.

I would guess that you are eligible for the Max also, but that is just a guess. All of this info is readily available on your state's website. Why don't you just look it up? Sheesh!

Why did you delay filing for 8 months? That will be a question that EDD will ask. You should have filed right away, the next day after you were laid off.

OP, Chevron HR says, with an almost all assurance, you won't have a problem collecting unemployment. The severance payment will not disqualify you from benefits. When pressed with more questions, you will be told that Chevron doesn't have control on decisions made by the UI processing office. Truly speaking, many things come down to who will be reviewing your application. If you are denied your claim, simply initiate an appeal. This will elevate the matter. When the State of California UI Office looks into the matter, they will ultimately get all the facts they need to start your benefits. Whatever time it takes to process is not known, but you will receive all back pay from the date you initially filed for benefits.
