Yes, we are entitled to severance since there is an established history of doing so:

"employers may be legally required to provide terminated employees with severance pay if they led their employees to believe that they would be paid severance. This is often evidenced by:

A written contract (often an employment contract) that calls for a severance package;

A promise contained in an employee handbook or book of personnel policies that tells employees that they will receive severance pay if they are terminated;

A history within the company of giving severance packages to other employees that are in the same or substantially the same positions as the terminated employee; or

An oral promise from the employer to the employee that he or she would receive severance pay upon termination."

Check the HR SOPs. Also, we should get unused vacation time but not sick time, and then of course you can collect your measley $200/ week unemployment, but not yet. You have to wait until all of the week's you have been compensated for have passed.

So, you might want to have the flu and burn up some sick time and once cut just take a vacation so you can get your unemployment benefits (which are rightfully yours by the way).

Who's worrying about that?

One poster said they were thankful to have a severance because there may not be one had they been laid off in the next round.

What a joke! After you got your severance check, you're worrying about netapp is running out of money to pay severance for the next layoff? Should I ask netapp to lay off me now before it's running out of money?

Don't think so. It's discretionary --companies don't have to give severance at all.

Yup posted today. Good thing as the cheap new CFO is slow playing vendors by pushing out payments. Next round of severance for the October layoffs will be even less generous. NetApp going down the tubes slowly.

Yep, Payroll said that it will be processed on May 27. Had me worried because the severance paperwork says that it could take up to 2.5 months after checklist is met.
