Who is getting scheduled those hours? We are down to 35 in our store. Bottom line is if you work 40 hours or more from Sun to Sat you will get overtime. If you don't understand this than you need enlightened. Your phishing for something that isn't there. Call a lawyer and they will explain it to you.

Let me enlighten you.
Let's say the employee is scheduled to work an eight hour shift on a Sunday, the start of the pay period. That employee is scheduled to work from the Sunday through the following Saturday all eight hours shifts, the employee is entitled to time and a half for Saturday, regardless of the hours the employee works the second week of the pay period.
The Act also states that the employer MAY NOT overlap work weeks.
A work week is considered 40 hours in a 168 hour week. Any time worked exceeding 40 hours in the 168 hour work week, requires the employee be paid overtime at a rate on time and a half.
So, going further, the employee does work the six straight 8 hour shifts in one work week, and only scheduled for four days in the second work week of the pay period, the employee would only get straight time for week two, but the employer would still be required to be paid time and a half for day six of the first week of the pay period.
So after reading that it confirms to me that they are not doing anything illegal.
There is no ambiguity to this Act.

In short, the FLSA states that the work week is a 168 hour work week in a seven day period. The employer cannot overlap work weeks for any reason.
So, if the work week starts on a Sunday and the employee works three days the first week of the pay period, and seven days of the second week, the employee is entitles to 8 hours at time and a half for week two.

That's not what the law states. Try reading the FLSA Act.
A work week is Sunday to Saturday. You could work 10 days in a row without working more than 40 hours in a week. (Starting Tuesday of the first week through Thursday of the next week)
HR makes the schedules. They drank the cool aide and just do what's always been done. I've worked many 7,8 and 9 days in a row without a penny of overtime. I am always told the store defines the work week as the pay period and not the federal or state law. I was told the regulations differ for retail. 9

FISA is very clear. No hourly, non-exempt, employee shall work more than 40 hours in a 168 hour week without time and a half compensation. Therefore, the regular Hamburg practice of habitually scheduling employees 7,8,9 and even 10 eight hour days in a row is a violation.
If there's a true case of a labor law violation you need to call the divisional team. I've dealt with them and it gets handled. That is if it is founded and a true labor law violation and not just a misinterpretation of a law.

You can believe it completely. Hamburg doesn't care about labor law. Pennsylvania has a 40 hour work week law and Hamburg violates that every week with full timers, especially during holidays. They claim they are on an 80 hour work week. No such animal under both state and federal law. No employee complains because they will be out on the street. Just say the word union and you are gone. Management there can always manufacture a reason to fire you. Hey, they even bring in lawyers to fight every unemployment claim.
If that rumor is anywhere near true, I smell lawsuit. Sad thing is though, this seems to be a standard operating procedure in most stores.
They sure did. Rumor has it that at least one Outfitter got fired because he was suspected of posting. No proof just suspected. I heard management thought one post read like it sounded like it would have been posted by this guy.
