Yes you do. They cannot discriminate when it comes to severance, it has to be equally applied. For example, if they were to let 100 people go and pay no severance whatsoever is fine. To let 100 people go and pay only one severance is discrimination, they are not legally allowed to do that.
I believe so. ..if you went back you wouldn't have a job.....due to elimination/not your due to appraisal.
