Favoring the advancement of specific nationality or race

There is now a court precedent where tech companies can be held liable for unequal treatment of non-Indians in hiring, firing and promotion decisions. So if anyone reading this has been unfairly treated on the basis of their race, there is a good chance that you can successfully sue F5.

The tide is turning the other way, not just at F5 but across the industry and across the country. It's time to say no to F5 employees who think it's ok to hire and promote based on race, country of origin or visa status.

Sadly, it's not only F5. Try to apply to other companies. The first questions they ask in the workday application form are your pronoun, your race, and your identity. Yet, they claim how "equal" they are. White caucasian male? Well, forget about the job. Colorful clown? Come on, you are in. Some time ago, these practices were illegal. The tech world is rotten.

It takes courage to stand up and take action. It will be the first step in regaining the dignity they tried to take, and getting back on the path to personal development and growth. The public needs to know that F5 hires and promotes based on race and nationality rather than on merit, and that nepotism is rampant at all levels.

Thank you to everyone who has contributed to this thread and helped me gather more info on this topic. Since my original question in this thread, I have since retained a lawyer, Joel Waelty, and am looking over my options for racial discrimination and made sure he was aware of the DuaneMorris court precedent .

is it possible to hire successful leaders? anyone who achieved anything significant in the last year or so? why do we have to stay with these loosers?

Those three are not the only few. whole chain of management under them, including few architects are part of the same dirty game. One, recruited his/her buddy. That person then recruited his/her buddies ignoring the most qualified ones. Folks raised up the ladder only he/ she is from the same region of the world as his upper management.
Every Indian upper management is responsible for this.

Non-management roles (Indians or non-Indians) in the US are gradually being moved to India because of the managers or VPs here who are Indians. Their only priority is to show a profit on the balance sheet, even if it means laying people off, f**k the company as much as possible, find another management role in another company and repeat the process.
So, lower-level US-based employees (Indian (H1, GC holders, or US Citizens) or non-Indians) all go through the same discrimination because of these selfish VPs (Sachi, Rekha, Dinesh.. to name a few)

That class action lawsuit is interesting for two reasons:

  • it shows that they went overboard to keep their H1B visa holders (presumedly because they are easier to manage due to the duress).
  • if suits like this catch on, the sc-mbag WITCH bottom-feeders' business models will need to adjust.

How can I prove this though? I’m a white female SE III in SJ CA who was passed over for a lucrative manager spot earlier this year because I wasn’t “a person of color”, recruiter’s words. The role went to an external applicant who moved here from India.

To be very specific, F5 management here in US is controlled by folks from southern part of India. If you study bit deep, if you from other parts of India, your hope to grow is very limited. Higher managing pull folks from their on region. Don’t believe, just checkout.

There are organizations within F5 where the entire management layer are composed of first-generation immigrants from India. The statistical likelihood of managers in Europe and the US all being from one country in South Asia, without there being a racial bias in hiring and promotion, is more than one in a trillion.

They’re filling some of the jobs with H1B but mostly straight up outsourcing. My team went through several rounds of layoffs. Each time they cut US based employees and a few months later they hired someone based in India. Just look at the job board and filter the openings based on location.
