Salary correction Gimmick of Service Based Company

Sequence of Events for Salary correction Gimmick:

  1. The employee’s visa is filed, specifying a new wage in the Labor Condition Application (LCA).
  2. The visa application is approved.
  3. Despite the approval, the updated terms of the LCA are not implemented.
  4. The employee, unaware of the LCA details, because they do not look there own document.
  5. The manager intervenes, presenting the salary correction as a favor rather than an obligation.
  6. But they will keep under paying till it found out and Managers will pretend they are helping you

What is employee should do :

  1. Verify LCA Details Upon Visa Approval: Request a copy of your Labor Condition Application (LCA) immediately after your visa is approved to ensure you are informed of its terms.
  2. Monitor Pay Adjustments: Compare the wage details in the most recent LCA with your paycheck to identify any discrepancies.
  3. Report Discrepancies to HR: If inconsistencies are identified, promptly inform Human Resources and request a correction to align your pay with the terms specified in the LCA

Who are these Service Manager :-

  1. They want EB1-C visa , anyone saying they are manager doing managerial work , in short they are fake want EB1-C.

If the employee isn’t looking at the LCA details why would you think anyone else is? YOU have to be your biggest advocate. Very rarely does someone go out of their way to get someone more money. If you have to jump through these hoops you need to be paying attention and hold other parties accountable for the implementation. It may not be “right” or fair but that’s true of any employee, not just those on a visa. Sorry that it has caused problems for you, I know it isn’t fun. Take it as a lessons, and understand that it’s not malicious.
