Can i still LR receive separation package if on LOA > 90 days?

I started medical LOA 2 wks leave prior to the LR announcement. Months earlier I had made in clear to my sr leader that I'd by happy to be LR'd; so I have a high degree of confidence that when I return from LOA I will be notified I am LR'd.

A Sr Director told me to be sure to return from LOA no more that 90 days from start of LOA to ensure I receive the separation package; he indicating that if i return >90 days, I am not guaranteed to receive the separation package. Is this true? For example, If I return from LOA after 120 do i put receiving my package at risk? Thank you

I believe paid leave is only 3 months so you would need to return at that time. hopefully you are well enough to do so. good luck

First, only HR can answer that question for you. Anyone can make up BS & tell you what you want to hear.

Why would you risk a separation package just to push off your termination into 2025? The amount of diff it makes to your taxes is a lot less than what you risk.

If I understand LOAs, you’re not guaranteed a job upon your return. That means they can say “oh well, sorry.” What I don’t know is if they have to give you any kind of package in the event there is no roll for you to return to, much less an LR package.

And why are you “special” that Cisco should extend your LOA just so you can have your severance paid out in 2025 while everyone else has to be paid in 2024? If Cisco wanted to be nice to everyone, they’d do their LRs such that your employment ended in Jan so it’s taxed under the new year & most companies gave their new year’s budgets & are starting to hire instead of letting us go effective Nov 16 so that it’s taxible at a higher tax bracket, and employers are not doing any hiring except critical roles until Jan/Feb because the hiring mgrs are taking vacations around Thanksgiving & Christmas.

If you are in the US: You are not guaranteed a package if you are on leave and tell your manager you want one. The information your manager is giving you doesn't make sense. Why 90 Days? I'd go to HR to clarify. You aren't getting a package if you haven't already been notified you're getting one. Cisco doesn't hand out packages just because you say you want one. Are you working with Cisco HR on this or just listening to your manager who has no power to keep you on or off the LR list?

If anything Cisco won't give you one. Going on LOA and getting LR'd upon your return could be seen as retaliation and Cisco could be sued. (Unless you are a woman on maternity leave, then yes...Cisco doesn't give a sh!t about you)

If you are outside of the US: your local laws and protection will apply.

I do have an approved LOA. It has been extended a couple times. I am scheduled to return on Oct 14, but I think I can get it extended another month, which puts me at ~100 LOA days.
My preference is to extend enough so that my final termination is in 2025 so that my separation package will be income tax for 2025. If i stay on LOA for 100 days, instead of 90, it will put my final termination in

Does not seem like you have an approved LOA - if you did you would know exactly when you should be returning... Come back and then go through options provided to you.
