Medtronic not reporting layoffs to state govt as required by law

Employers in Minnesota are required by law to report layoffs of more than 50 people. Medtronic stopped this practice in Minnesota years ago.
I am sorry to all of you have been laid off. Being laid off is terrible. Layoffs are the result of poor decisions by management. Period.

The MAX penalty for ‘violation’ of a WARN notice is 60 days of pay. Companies are compliant with WARN without a notice if they provide 60 days of pay as part of the separation. It’s what’s known as ‘pay for notice’

It seems to be the trend that large companies, who are already providing 60+ days of separation, want to avoid headlines and the associated perceived business intelligence with publishing exact numbers of headcount associated and with business units/locations.

The closest we will ever see to official numbers will be a footnote in a SEC filing with the associated cost of headcount reduction. Never going to get numbers of people impacted (officially)

I find it interesting MDT had to report the layoff of 44 employees in Carlsbad, CA for last week but hasn’t reported anything for MN. Shouldn’t we expect a similar WARN notice in MN too?

Don’t know how warn reporting works? Glad your ex-hr because a simple 3 sentence reporting guideline was too hard to comprehend.

Oh, and the layoffs must all occur at the same worksite. So Neuro would be different that CRHS.

I believe the 50 layoffs must represent at least 33% of the workforce for the WARN act to be activated (or 500 people) and these need to occur in a 30 day period. My guess is that Medtronic makes some very surgical strikes so they don't have to worry about the WARN act. It could also be a factor for having layoffs go on for months, instead of all at once.

Medtronic didn’t report any of it to any of the states. I looked at them all.
There is no fine or punishment, so they don’t care.

You must have been a sh---y HR director if you weren’t aware of the ‘pay in place of notice’ approach to the WARN requirements.

Or you’re lying about being a HR director.
