Sorry i didn't finish my post. Yep MDT usually avoids any warn notice and did so in the MN 2023 layoff because they use the pay for 8 weeks on the books for the layed of employee as the time requirement to meet the warn rule of 8 weeks notice
We didn’t need a WARN notice in Minnesota for the 2023 layoffs because the law stipulates if you notify staff 60 days before their last day then you don’t need to file a WARN. This is why MDT keeps laid off ppl on payroll for the amount of time they do.
Warn notices are done per economic/geographic area. The Vent/Carlsbad layoff was an easy gimme to file since they announced the Vent business changes to occur. It's also based on % layoff in the area.
2023 layoffs MN area - no Warn filing. Maybe because they didn't hit the % threshold, but that seems unlikely.

Sorry these folks are out of a job, but this shouldn’t be a blindside.
It also shows those people in the other thread who are predicting rolling layoffs to avoid WARN actions have no clue what they are talking about, or how the law is applied.
