Officially, that would be November 26th. However, in my personal humble opinion, I don't think that they'll be able to drag it out that long because of a multitude of potential fallout scenarios that would likely come from disgruntled and litigious employees and/or shareholders, and so I think that realistically, whatever they decide in terms of either moving forward without China's approval or cancelling the deal altogether, it will have to be by this coming Monday, November 6th, assuming they don't get something from China before then of course.

Dont trust what your manager tells you. Directors and below dont know $h9t at vmware. They keep them in the dark at all times.

Manager told me yesterday that Nov 26th is the final date or its off. BC would need to start from scratch if they wanted to continue the acquisition beyond that. Would require another round of approvals and renegotiate terms.

Could drag out for years if both parties want it. Doesn't matter unless China approves. Vmware can only operate with pauses due to aquisition for so long before eventually lawsuits happen. There needs to be backfill for positions and sales needs to be able to sell again and customers will need to re-sign

I agree with @ulr+1poGq4hM, for what it's worth.

If this doesn't close by Nov 26, BC won't try another bite at the apple. They're probably already regretting getting involved. And if Hock gets embarrassed by this, he's not going to risk a do-over. Because what will have changed to get Chinese approval in another go-round?

I think if it's blocked, the most likely outcome is several months of turmoil while MD shops VMW--either whole or dismembered--to PE firms. So along about April or May we'll be doing this whole dance again. Though I do expect headcount to be self-reducing during that time. Because how many of us see a future--not just a bright future, but any future--in staying with VMW?

Perhaps this is the wrong question, given the history of this deal thus far.

Instead, how long will it take for Hock Tan to accept the outcome with China, and complete the deal Termination fee negotiations with the VMware board?

My absolutely uninformed opinion is that a renegotiation is unlikely if this goes past the November 26 final date. Based mainly on how much higher interest rates are now than when this first surfaced, I think that financing an updated deal would just be not viable.

But I am not a lawyer, finance expert or corporate raider
