What are the options for impacted H1Bs?

I am one of the H1B visa holders who got impacted today in San Diego with 12 years at Qualcomm. What options do I have? I bought a house last year and have kids here in school. Please be respectful in your comments as I am very stressed right now and could use some encouragement. I didn’t expect this was coming and I was one of the major contributors in my team. Also surprisingly our team don’t have many Indians, so I thought based on my performance and diversity, I should have been very safe.

H1-B is a temporary work visa. You should not buy a house as a temporary worker. There are a lot of jobs in India maybe you should start your job search there.

I was in your shoes a while ago. You have time from now till 60 days after the payroll stops to find a job. Total of 4 months is not a bad deal. After that you must submit document to change the status or leave the US, B2 could be an option but there some other options like get an F1/F2 visa by registering for some class or you could contact a consultant companies, quite a few of them will help you to look for jobs with some fee and when you are jobless, they will help to keep your h1b. It is easier to transfer H1B to another company than reactivate it. If you change visa to B2 or F1 you have to reactivate your H1b, with premium fee it will take like 3-5 weeks. Unfortunately, you can't work during this period.
Let 's get positive, you are a great person, and the US is still lack of engineers. There are plenty of companies still hiring, it might be a great opportunity for you. The company must do what it needs to do to survive and please their investors. It is not your fault for it to happen.

To the OP: haters gonna hate, they have nothing no better to do. Disregard some of the comments below that are obliviously coming from folks who will never know what it takes to uproot yourself from the place one grew up, to aspire, to contribute & make impact while standing in the H1B line for decades if not years. All the while paying taxes and bringing diversity to a place half way across the world. Some really positive comments below as well. Please consult with an attorney at once. Op - I was impacted today as well, and I think it is finally hitting me that I don’t have anywhere to go tomorrow. I’m trying to find the logic in this situation but admit right now I’m just really hurt and disappointed in a company I believe in. There is no trade off for someone who takes pride in a job well done.

I will keep you in my thoughts, and hope everything works out positively for you and everyone else impacted. I absolutely loved working for Qualcomm, and will miss my co-workers. Be strong and open minded.

OP,
With 12 years of experience, I am pretty confident that you will get a similar job very quickly. Just give yourself a couple of days to fresh your mind, basically do nothing and then go full throttle… You might even get multiple offers.

I've been in this scenario with my ex-employer, if not, far worse. I had only 60 days (blindsided, no WARN ACT in New Jersey) to find a new job with just 2 years of professionals experience in the US. You have 4 months with 12 years experience! so chin up!

  1. Although the market is down and slow, it is not dead. When I recently turned on the "actively looking" on LinkedIn, I was contacted by many recruiters. Take LinkedIn premium right away.
  1. Talk to an immigration attorney (ideally 2 months from now) to flesh out a plan B for you. You can possibly move to B1 and continue to find a job and save some H1B days. Talk to an attorney.
  1. Do not hit the panic button. You need a sane mindset to prepare and crack interviews. So focus there.
  1. It doesn't hurt to ask for help with friends and family

I believe you can change the visa from h1b to b2 status when looking for a new job. Check USCIS memo or an immigrant lawer

If you wish to remain in NA think about applying for Canadian permanent residence. You can get Canadian passport in 3 years and then work in US on a TN visa.

I am sorry, OP. I used to hold H1B 13+ years so I know the pain.
Please talk to your immigration lawyer immediately and ask what options you have. Then look for a new visa petitioner (employer) and expand your search area and be open for a new city/state. Smaller companies might be better as less competition. Though it's not ideal, please consider renting out your house as I assume you don't have much equity built yet.

Dear OP,
I am impacted too but luckily out of H1B but having lived through that stage I can feel the stress that you muse be going through.

Please take a step back and know that you have multiple options. You most likely will land a job sooner than you expect.

And please take the next comment in right spirit, I say this with utmost sincerity. Recognize that you do have the ultimate, possibly tough or even impractical option of returning to India. Not everyone is able to do that (sorry for assuming you can, but I hope it is an option for you). It has its pros and cons but point is it does have its pros. Your ultimate responsibility is to provide a good life to your family and that is very much possible with this should you have to and many a things may work out better. You don’t owe anything to anyone and do not have to care about what anyone says. Plenty of jobs in India should you move.

Nothing is worth the stress that comes with this. Funny I say it as I am trying to handle my own stress. Engage your analytical brain more, use the severance buffer if you need and believe that things will work out in some way.

I am so sorry -- and I know this is though.

What I read today and kind of made sense to me is

  • tell family, neighbors and everyone you need help. Asking help is not something people should be ashamed. It is a strength. You are fighting for your family! So do not get stressed. I know it is easy to say, but stress makes things worse!
  • Worst case (if you can not find a job), try to enroll into University programs so that you have some status. But, I am sure you can find a job within 2 months! Wish you the best!

I wish you find a job before the H1B clock runs out. For backup , is your spouse on H1 ? You can probably switch to H4 if nothing works out
