A patient who was ra--d last month at Ascension Via Christi St. Francis by a Wichita man who sneaked in and posed as a nursing student has filed suit against the hospital, alleging the health care provider was negligent and missed clear opportunities to stop the as--ults.

Third victim sues...

  • The latest plaintiff, identified only by her initials T.R.W., was a 47-year-old woman recovering from a traumatic brain injury stemming from a motor vehicle accident. Due to the extent of her injuries, T.R.W.'s arms were in soft restraints, tied to her hospital bed, according to a release from the law firm Monday.
  • According to the lawsuit, no one from Ascension ever spoke to the victim’s family after the incident to inform them what happened to her. The victim’s spouse only learned the details of what happened from law enforcement.
  • “It’s awful,” says Andrew Hutton, founding attorney at Hutton & Hutton Law Firm. “She was absolutely helpless, and Ascension failed to even inform her or her family what had happened.”

Second victim sues:

Shortly after midnight on June 15, a man wearing a t-shirt and basketball shorts entered Ascension Via Christi St. Francis by following an employee through an entrance. The man, identified as 28-year-old Miguel Rodela, entered the St. Francis hospital just after midnight by following an employee through an entrance.

The law firm contends that that after allegedly ra-ing a patient on the 8th floor, Rodela made his way to the second victim’s room on the 7th floor and se-----y as--ulted her. Hutton & Hutton said the second victim was an 82-year-old cancer patient.

“This woman’s dignity was stripped away at one of her most vulnerable moments," said Matt Dwyer, attorney at Hutton & Hutton Law Firm. "And it was allowed happen in that hospital in one of the most upsetting ways possible.”
