NLRB does not allow employers to prohibit any employee from speaking even if... they are asked to sign a severance or separation agreement. Avaya can't legally scare you from sharing your experience or posting on this site. If they try to, you have further legal recourse and this is considered intimidation and bullying.

  1. YES. It is not lawful for anyone to tell you that you can't express your feelings, per the very recent NLRB ruling. Separation Agreement or Not. Any employee or ex-employee can legally say what they want. Same applies to that one who posts babble or suggestive photos tagged to her job. Are they qualified? That's a different question. But can they act like their non-relevant posts are somehow tied to their role at Avaya. Sadly, yes. Annoying. But Yes.
  1. Exactly. No one ever saw your iPad. Unless you are telling us that you received a targeted message via email -- that would be a violation of law if layoff identified your device and sent the info to Avaya. It's more probable you are just paranoid
  1. I'm constantly amazed about how little Avaya employees really know about technology. Including & Especially the so called self-declared "experts"
  1. Time to face what Avaya is. It is a holding company of some assets (#1 customer base. #2 IP portfolio, which is rapidly declining in market value, #3 ________ whatever they hid in Dubai last year) which is owned by Private Equity AND the CEO. Avaya 2017-2022 survived on borrowed money. Money that was easily available in the market. If they failed, which they always did, they just shuffled money around to make it appear as if they hadn't. You can only do that for so long. Even in a low cost money market. It caught up to them before the money became expensive. So there is no more pretending they are spectacular and "back" as they could in 2018. There are few to no options to get more money. They have to make it work with the little they have.

Yes. That is not how it works.
They can only identify IP addresses at a Macro level (can see trend of Avaya IP volume)

Individual -- only with a court order to seek deeper data.

This site manages cookies. So it will know device via cookies from browser. And it can track IP but just when relevant (ie....repeated responses, spamming or justified Court orders).

I've never seen anything in here that warrants a court order. AND...should Layoff dot com be giving Avaya IP addesses in exchange for advertising dollars or a fee, they are violating terms

Thus, between NLRB and privacy terms, they can't take any action against anyone. If they do, an attorney would love to go after them.

That’s not how it works.

The website sees the IP address assigned to your connection from your ISP, not your device’s local IP (it’s kind of scary you work for a VoIP company and don’t realize this).

If you’re posting from a company owned asset, ie your laptop, or posting while connected to a corporate network, then yes…if someone WANTED to invest the energy to go through the logs (proxy or LAN) they could trace back your web activity to your device and your account…but that’s not anything illegal (you’re using their device and/or bandwidth).

Some time ago I posted using my iPad. Someone responded to my post specifically and knew the name of my IPad. Obviously he was able to drill down to the IP Address of my device.
