Severance policy if laid off after initial retention

After acquisition close assume you get a offer from BC then 2-3 months later BC has more layoffs as they continue optimizing their workforce and you get laid off. Which severance would apply?

This would particularly sting as BC has a lousy severance package (2 weeks / year) vs if you had got laid off at acquisition it would be VMW severance package of 2 months + 1 wk/year.

I had heard someone say that per the acquisition agreement BC has to follow VMW severance for 12 months, not sure if that is accurate or not.

Does the current VMW severence policy pay on your OTE? For example a quota carrying AE also makes commission. Does the severance cover this also or do they only pay the 2 months + 1 wk/year for the base salary? If so that's pretty bad.

A colleague of mine, in VMware since 2011, saw his role cancelled, and 50k in total if he decide to resign or an option to apply for another minor role, I don’t know if they gave also other money to accept but he is still in VMware.

VMware severance is capped at 12 years (as per current official severance policy published on source site), so it really doesn’t matter what Broadcom severance policy is if VMware one will be used for the fist 12 months after the acquisition.

Does BC have a cap on the number of weeks severance? If I've been at VMware for 15 years, are they really paying 30 weeks?!

Policy under Broadcom is better than anyone else. Symantec acquisition gone through it and they kept Symantec severance policy for 12 months which was 2 week/year. But those who got laid off after this 12 months period got 1 month/year severance.

Many old (10+ years old) folks/directors planned for it.

You are exactly right. if you read the documents submitted to the SEC, the agreement states that existing vmw employees will continue to get VMW benefits for 12 months and specifically notes that the severance policy will be VMW's for 12 months.

Any of these other trolls around here that say different are just non-reading, non-researching angry little people under a bridge.

I don’t know the policy, I simply assume any policy under Broadcom will be way worse than under VMware. Wait until you see how sh---y our health plan will be!
