Can you be laid off while on vacation? I know this might be a stupid question, but I’m kind of hoping that my manager wouldn’t approve my PTO if he knew that I’d be getting a call in the middle of it to tell me I no longer have a job. Has this happened to anybody?

You can ask for more weeks of severance, cobra, upgraded outplacement. They will say no, but you can use the wear them down strategy and keep asking. Regarding unvested rsus/options, can’t negotiate as those have strict regulatory requirements. Your contributions to the 401k are yours. You can read the 401k plan.

@Retired HR; by negotiable, what is the easiest agreeable lever for them? Extra weeks? Unvested RSU/Options?
Also, does MDT not allow employees to keep their 401K with them and force a liquidation to IRAs?

In the USA you can be laid off on any day. Fmla, maternity, pto, heart surgery, cancer, christmas, yom kippur, in the middle of the ocean on a cruise- if they want to end your employment, they can and they will.
Use your personal days as those don’t get paid out.
And if they tell you severance benefits are non-negotiable, they are negotiable. Everything is negotiable.

You absolutely can be laid off while on FMLA, however you cannot be laid off BECAUSE you are on FMLA
What if you don’t have a work phone?
I was told you cannot be laid off on any part of maternity leave (FMLA, baby bonding or HPP) but who knows? Doesn’t seem like they care much.
if you are OOO on RIF day, they will track you down to give you the message. doesnt matter PTO, sick, work travel. Dont worry, they will find you.
MDT is a "at will employer" you can quit or be fired at any time, so YES you can be released as needed regardless were your at the moment.
I was laid off from a startup on my day off. I took the day off to interview with MDT because I knew it was about to hit the fan.
I was laid off during vacation, got a call on my mobile, it was my boss and HR, bring in the laptop "when you can".
They will lay you off on vacation, maternity leave, medical leave, etc. New baby, no job. Ask Google. They set the standard.

One of my colleague during 2020 layoff was on VS action and was told by phone not to show up to work anymore.
Employment is at will, expect to be laid off anytime
I've known of people getting called during their PTO to be told they are being let go, and others told on the day they get back. Seems to make no difference.
Word of advice. Some companies pay remaining vacation days as part of severance but not personal days or whichever other category days you can use as time off. To maximize your benefit, save whichever type your company will pay out on and be sure to use the other types for time off instead.
Of course they can. They won’t consider your PTO whatsoever.
I’m curious about this too. I have upcoming time off scheduled for my kids’ spring break. Would be great if they did the deed before that if it’s going to happen anyway.
Couple colleagues were laid off during their PTO or vacation last week while Neuro layoff happening.
