3M did not design nor manufacture the majority of these earplugs. The lawyers are just coming after 3M because they can’t sue the DOD (who approved the design and performance of the earplugs) and Aero doesn’t have deep pockets.

Unfortunately, it doesn't matter what Patolawala or Roman or Rhodes believe they have or haven't done. The opinions of the jurors and federal judges is what will determine 3M's financial liability. It's obvious that MDL Judge Rodgers is biased. And how many jurors are going to choose the "big, bad, evil" company with deep pockets over the veteran who's sitting right there in the courtroom looking at them?
