In Canada IBM offers just above the minimum required by the law as written, any decent labor lawyer should be able to get you around required by common law (legal precedents) which is much greater, especially the longer you've been at the company.

Also, if you get RA'd IBM will pressure you into immediately signing the paperwork to accept their offer, implying that if you don't sign you'll get nothing or much less. Total BS - don't sign away anything without talking to a lawyer. Bonus: watch their reactions when you say you'd like your lawyer to review the paperwork. :)

Roughly a $450k win + legal fees. What's sad about this story is after 38 years of dedicated service this guy put in - he was treated this way in the end by the employer. Sad. Big difference from what the employer offered - 11 weeks of working notice (+1 in lieu of notice) and 26 weeks severance and accrued vacation and no RSU's.

Impossible to lay off a canadian... definitely not. Tell that to the entirety of my former team. It is certainly more expensive to get rid of a Canadian but not even almost impossible.

It is virtually impossible to terminate a Canadian. We had one guy on our team who was put on PIP 8 times in 3 years and never passed the requirements of any of them. He would openly announce and joke about it everytime. He eventually left on his own terms.
