3M Earplug Lawsuit Update: 12/25/2022

Just one more comment on Judge Rodgers’ ruling this week. The one thing that always stood out as the most hypocritical part of the bankruptcy effort was 3M’s effort to reduce the punitive damage award in Wayman because there were not six defendants but just one because 3M “owns and controls 100% of the other five named defendants.”

The hypocrisy is obvious but this affliction is seen with lawyers on our side of the aisle too, to be honest. But what is striking is that 3M had the audacity to make this argument after the bankruptcy scheme first was concocted in the early spring of 2022. You just wonder how that could happen.

In any event, as we lean into 2023, 3M is running out of cards to play in this litigation.

Those saying 3M doesn’t have liability, they do. They’re supposed to go through rigorous testing prior to a purchase. Those in the comments are basically saying the “car they sold” to someone that got into a “severe accident” should fall back on the person that sold the car, not the one driving. Buy a company you take on all the assets along with liabilities!!

How is 3m showing criminal actions regarding the ear plugs. They bought the company that made them, so how in the world should it be okay for them to be sued for something they didn’t make? What should be criminal is the lawyer that rob the people who win the lawsuits. Why do you think they push these kind of lawsuits. It’s not the people who win it’s the lawyers. Open your eyes people….

To the poster who started with "you people." You sound very entitled. Speaking down to the pedestrians from your pedestal to people expressing their freedom of speech.

Personally I think criminal action is not winnable in court, but the moral and ethical thing to do would be to resign if appeal in 7th circuit is lost. New leadership should be considered at that time.

I don’t buy that the lawsuits won’t be successful. They’ve proved enough already to win 10/16 earplug cases that have gone to trial leading to $265 mill to 13 plaintiffs.

Which leads me to - How the heck does company survive this if there are 250,000+ plaintiffs left?

Or what am I missing?

You people are so funny….. time to prosecute. 3M didn’t even make the earplugs. A company they bought did. There wouldn’t even be a lawsuit had 3m not bought it. Further more how can you even prove that the soldiers even wore the earplugs. Grow up and get a job and earn your own way instead of trying to sue people to earn money.
