Rehire after PIL?

I was so shocked - stunned - ambushed - infuriated after my NSI, once I realized I could get a substantial LS payout on my pension, I didn’t really read the fine print of the paperwork - I promptly took the PIL and left. No attorney reviewing my documents, I just felt so grossed out and betrayed - I couldn’t get out of there fast enough.

In retrospect, was there specific language that indicates NO rehire after a PIL? Not that I’d ever want to go back (I never would!), but honestly cannot remember. Was language to that effect in there?

What happens if you disregard what you agreed to and re-apply? Would the company sue you to return your PIL severance?

If you resigned as part of the PiP/PiL process or got canned as part of that process, you signed an agreement that you would never be able to work for EM or any of its affiliates again. Note, this doesn’t apply to JVs where we do not have a controlling/hiring interest.

If you quit outside of that process, you signed no such agreement and can reapply.

I’m pretty darn sure that the company worded the agreement to keep its options open, while restricting yours. In other words, the company can contact you to offer a position, but you cannot apply for a job uninvited.

Why do people assume the worst….that when a person leaves, it’s because they took PIL if not RE? On the contrary, some people simply resign because they are fed up and have better things to do.

If the company wants to rehire these individuals, then they can make their best offer. Not likely from the company side because the goal is to mindlessly reduce headcount. Not likely from former employees’ perspective because most would rather chew off their right hand then come back to this cesspool of toxicity.

If XOM broke your left leg once before, why would you come back and have your right leg break as well? XOM is a toxic place that must be avoided at all cost.

You cannot rehire someone that’s retired. If you take the PIL and take your pension, I think there’s some issue there, but not sure

I don’t recall such a form as I resigned in 2022 as a regretted leaver. Couldn’t take the disrespect from the string of bad managers.

I suppose they can rehire regretted leavers, but I believe the current practice is to bring competent individuals back as contractors if they are available.

EM can get in line for services from these former employees. Some skills are not replaceable.

In practice, the agreement to “no rehire after PIL” seems more like a threat than having any permanence.

If at some time in the future the Company wants to rehire a PIL employee, and the PIL employee wants to be rehired, then wouldn’t both parties would just agree to terminate the existing “no rehire after PIL” provision?

I never saw the PIL language but I know the company internally keeps a record of all former employees with a “regretted” or “non-regretted” termination. Everyone who was “good” or higher and left voluntarily is “regretted”, as was everyone who was part of the involuntary RIF. As far as the fake “performance” separations my understanding is that all of those folks were marked as “non-regretted”, which would mean the PIL takers as well.

OP here: I found the waiver and release I had signed in 2021, and tried to open it up, but the docusign link had expired. I’ve reached out to the HR person a couple times, but think they’re gone, too? Wouldn’t surprise me - that job must’ve taken a serious toll on the psyche.

Now that my mind is finally in a better place - It would just be nice to know all the rights I was forfeiting.
