This is not early retirement, it's only early separation. Lump sum payments for time served and health care. It's like "Let's Make a Deal". Do you want door number 1 (cash) or door number 2, risk lay-off (less cash + unemployment).

It's Voluntary - no grounds for litigation. If you don't want to accept the offer, you don't have to.
You can take legal action, but you need to contact a lawyer. There was a message on this blog about legal action taken for those 50+ and laid off. Read the message for more details. The message says a class action case was opened up with Sanford Heisler Sharp, Medina Orthwein and Desai Law Firm.

Being over 55 and almost 20 years here if I’m not offered a retirement package and I’m laid off with less can I take legal action?
What does the package look like and how is it calculated?
Will everyone or 55 with more than 15 years of service be offered?
Are they offering to pay for Healthcare until you get Medicare?

Focusing on executives and diversity, appears to have cost WDC hundreads of experienced engineers in its core buisnesses. I hope someone's considering a change of direction.
I barely missed qualifying, but I'd take it. Think of it as a paid sabbatical. Toward the end of this year things will be back to normal, start a new gig somewhere else. 55 is the new 45.
