Do recruiters get unemployment if they are laid off from a performance plan?

I think it depends on the state you're in and how much the company fights it. I've heard that Med Sol doesn't fight it, but idk.

@ep 100% false. It doesn’t matter what brand you work for. If you are fired for not making the ridiculous quota, aka PIP, you can file for unemployment. Don’t let the managers of a dying business scare you. Ride out the PIP. Do not quit. Make them fire you. Don’t let the people living on easy street scare you into quitting. In your meetings just keep saying “I’m doing my best!”

At Host, recruiters do NOT get paid severance at all for being laid off from a PIP. Does MedSol do that?? I’ve also heard that people in recruitment that have gotten laid off from PIPs get denied unemployment because of the reason they were laid off.

I didn't collect any unemployment. I was lucky and saved enough while at Medical Solutions to coast until I became employed again. But filed for food stamps and obtained that a month after the severance was paid out. For that at least in my state, they classified it as wages so I still made to much the month it was paid out so had to wait a month for that benefit. Once I became employed again, the food stamps dropped.

Unemployment that process takes a bit to go through the proper channels so starting that early isn't a bad idea. But depending on your state and how they classify the severance will determine whether you get the benefits right away or if you have to wait a period of time.

Rules can vary state to state, but generally speaking just file the claim. With waiting periods and the time it takes to get everything processed, you may as well start early. Also, don't be afraid to get in touch with the Department of Labor people, they were quite helpful to me, certainly more helpful than anyone at Medical Solutions.

The severance was based on "weeks" so unemployment didn't treat it as a lump sum, but rather has my getting paid for those four weeks, and then unemployment would kick in. I was fortunate to have a job quickly, so ultimately I didn't receive any benefits, but for those people I knew who were unemployed longer, they did end up collecting.

I believe it's an x amount of time after your last paycheck and once the severance is paid out that you can't file for unemployment during that time. It takes a few months after since they classify the severance as "wages." I think that is what they meant below with the comment of if you take the severance you can't get unemployment. It takes a few months after the final payout to be able to qualify for it since you usually have 1 final paycheck and then the severance that follows the following pay period. So, in total could be waiting a month or two before you'd qualify once the "wages" end.

If you are laid off and receive severance, you should still be able to file for unemployment. I know of a few people that took the severance and filed for unemployment.

I second the comment below! Read the fine print in the severance package if it is offered to you. Majority of the people laid off had that clause in there where if you took the severance you couldn't file unemployment. You kinda have to weigh your options with that and which one you'd prefer to do.

@OP Yes, you get unemployment. Don’t let your manager scare you away from filing. They are accustomed to the same tactic with travelers, so they will try to bully you as well. It is your right to file. After all, the company pays into it. A few things to keep in mind. If you quit, it’s more difficult to get approved. If you are fired for performance, most states have a week waiting period, so file asap. If you are laid off, you most likely will get a severance. Read the fine print. These greedy a-holes typically have a clause in the wording stating if you take the severance, you forfeit your ability to file for unemployment. Honestly, the best decision I’ve ever made was riding out my plan. Drew unemployment for 6 months. Finally found a job in a completely different field. I am so much happier! Took a slight pay cut, but sleep so much better. The stress of the recruiting business isn’t worth taking years off your life.

You should, but if you receive a severance, then the unemployment office will likely tell you that you have to wait a a certain amount of time before qualifying.

You should yes. Technically it would still be classified as a layoff/termination even with a performance plan.
