It makes them think twice before laying you off. Especially if it is for EAP type stuff. Come back May 1st and it should buy you an extra year or two.

Actually I am a manager at Medtronic and I can say that I don’t want to deal with BS. So when I look at the roster on my team to layoff and I see a depressed or pregnant woman - I don’t lay her off - it’s not worth the trouble or risk. The white male is much safer and trouble free
You’re not allowed to be terminated BECAUSE you are on leave, which is different than being terminated WHILE on leave.
For example, Janice can’t be terminated because she is pregnant and about to go on leave. However, if she is out on leave and her function is eliminated, they are allowed to terminate her because her function is no longer needed. If, however, she can prove that her being on leave contributed to them terminating her, the company is in trouble.
Alternatively, if you get called into a meeting with your manager and HR and you yell out ‘Olly Ollie oxen free!!!’ Before anybody says anything, they cannot terminate you, so you’ll notice HR and your manager are instructed to perform satanic chants while waiting for you to enter to curtail this little trick.
Actually if you decline the layoff meeting in outlook with HR, and your manager, you technically cannot get laid off. Furthermore if your manager approaches you, and you cover your ears saying something to the effect of “I can’t hear you “ - similar immunity will be granted!
Guys, they can plan layoffs, but if we can disrupt the process then we are in control. Who’s with me?
That’s not how this works. That’s not how any of this works.
They don’t wait until leave ends. They will terminate you while on leave. Or, if you call in sick. They will terminate you and send you your information.
There is no empathy.
Sometimes just being out sick the day of layoffs will do the trick. They will move on to the next guy and forget about the whole thing the next day.
That's not how it works. They'll just change your RIF date. Going on leave will solve nothing unless you come back pregnant. I did RIFs for years. You just wait until they come back from PTO. D-mb advice.
