H1B Visa employees safe but American employees fired

My IBMC partner told me that she couldn’t select a H1B visa person as part of the RA. She wouldn’t get credit against her headcount exit target because they aren’t US employees. She offered to send them back to India instead but was denied. The resource action funding could only be applied to US employees. Why is it legal for IBM to do this ?

If out of the ordinary an H-1B get laid off, it’s because he rebelled and didn’t follow the work orders of the sweatshop cast system, and deportation is next.

So If you are an American employee recently laid off from IBM, it’s fair to say that you have been replaced by either cheaper younger H-1Bs or by Indians in India.

H1Bs are the new slaves of America. Most of them are Indians and mistreated here in the US by other Indians, their masters (managers). It is just another implementation of their stupid cast system!

I know more than a few Indians on H1B, while they are grateful to be here in the US because life is a lot better than in India, they are suffering greatly because they are abused at work.

Of course, it’s true; H-1Bs are notoriously cheaper and slaves of the sweatshop; with the immigration system, they have a “rope around their neck”; so that reason , they don’t get laid off

I would not believe it. H1B are employed in the US as local employees. The only difference is that after an H1B is lay-off, the employee must leave within 30 days the US. I am a former H1B employee who was lay-off years ago.
After the lay-off one does not receive the unemployment benefits as one needs to leave the country. One does not get a "relocation support". Just the pink slip. Kids need to leave school. The whole family needs to leave unless one finds a new job with H1B visa within 30 days.

She cannot "send back to India". She might offer one airplane ticket to the employee. No relocation.

Please verify with your IBMC partner what she could not too. I would be happy to be wrong.

P.S. I am a 'fellow' US citizen.
