Lawsuit - army ppe - proof the plugs were worn?

I haven't paid much attention to the litigation regarding the combat arms ear plugs. (Aereo/3m)
I've worked in several manufacturing sites and can tell you a lot of people won't wear PPE unless you tell them to/raise voice. In the abyss of the trial, does anything prove they wore it when in combat/training? Is there a way to prove it was/wasn't worn? or is that hearsay?

Just curious if someone has a link or read it somewhere. I understand that if 230K came forward they'd have proof instead of just proof of purchase!

You had orders from top to bottom to wear hearing protection anytime you operated a piece of equipment. Let alone when your firing your we---n.

THanks. So based on a few comments the lawsuit is more around moral fiber and cost of poor quality over proof of usage. ie it doesn't matter if they wore it because if they did it would be like they didn't anyways

Documents from previous lawsuits against 3M, filed on behalf of service members and the Defense Department, show that the manufacturing company was aware that their earplugs were inadequate as early as 2000, but withheld this information for another 16 years.

Problem is that it's 3m vs the word of former and current soldiers. Good luck winning in the court of public opinion or in any court at all.

Or the only one ear plug that caused hearing damage?
