There was no settlement from the settlement talks last week.

September 16, 2022 Update
As the parties begin Day 2 of court ordered settlement talks, the number of lawsuits listed as active and pending in the 3M Earplugs MDL went down for first the time since the start of the litigation.

A month ago, there were 293,831 cases listed as pending in the MDL. In the most recent monthly report from the JPML that number is now down to 254,134. The reduction is the delayed result of steps Judge Rogers took earlier this year to clear cases off the docket where the plaintiffs were unable or unwilling to provide military service records in support of their claims. Reducing the number of total claims is good for 3M and good for victims who want to get a global settlement done.

Anybody who takes a small company they own and files a bankruptcy in order to cheat the system to me says 3M is guilty.

Oh they believe in the system all right as long as it benefits them. There is obviously a problem when over a quarter of a million Americans come forward and report it.

If there were honorable people running the company they would find a way to take care of not only veterans who are injured but people in other nations who have had their water contaminated by 3M manufactured products. This isn’t just about earplugs it’s also about the contamination of water. If your kuds suddenly developed cancers and rashes and other illnesses and it was discovered that it was the water in your neighborhood contaminated by a commercial product, you would be raising cane to get something done.

If you KNOW your 'minimum settlement' would mortally wound your opponent, that's fine, but you aren't really negotiating.

You are refusing to negotiate.

So your opponent has no reason to negotiate either.

There is still enough unpredictability about the situation (J&J bankruptcy precendents).

This might go on for awhile.

The more Big jury awards they get the bigger the exppecations in the plaintiff's camp.

But they risk getting nothing if 3M goes bankrupt.

They have the power to ki-l 3M.

3M probably can give them more real money over the time they need it by avoiding BK.

But their hubris will likely backfire.

Negotiation is not merely accepting any old offer laid upon the table.

If you are trying to buy a house I am selling and offer $50K when it is valued at $450K, my saying no is not failing to negotiate.

Maybe win win would be 10B. I heard from knowledgeable source that plaintiffs want 40B. So they aren't really negotiating.

NO SETTLEMENT. This is not surprising and great news. The plaintiffs want so much that it will essentially bankrupt the company. So they aren't really 'negotiating' and have publicly stated as much.

And 3M knows the judge's crooked actions will come out on appeal and they have a very good shot at getting the aearo bankruptcy treatment because their case is better than J&Js. Aearo was a real subsidiary and the supposedly bad activities all took place before 3M even bought the company. Those are two huge facts vs. J&J situation.

Why would 3M settle now to terms that will basically leave them in bankruptcy?
Especially when future proceedings will make it clear the MDL has been handled in a very biased way.

J&J precedent proves pushing these ridiculous non-science based claims into bankruptcy is the only way the US legal system can deal with them.

It's easy to get an ignorant sympathetic jury to give a big award.

But ultimately these plaintiffs will get NOTHING, either they will lose in court or 3M will declare bankruptcy and they can get in line with everyone else.

So again why would 3M ever agree to bankruptcy now without letting the legal system play out?

Win win would be about 10 billion. 3m must sell off a division and also stop paying dividend for 3 years. That would cover things and move this along without our losing our pension in bk court.
