Product liability is a term used to describe the legal liability of manufacturers or sellers of goods to compensate buyers, users and even bystanders for damages or injuries suffered because of defects in goods purchased. Product liability law is the area of law governing product liability litigation. Though the range of defective product cases is broad, the claims typically fall into three categories of product liability: (1) defective manufacture; (2) defective design; or (3) failure to provide adequate warnings or instructions concerning the proper use of the product.
The product should be both merchantable and marketable. Any defect in this part would bring liability on the one who sold the product or the one who manufactured it. The consumer cannot be expected by the seller or the manufacturer to specifically examine every aspect of the product.
Therefore, 3M is legally liable for any defective product (including ear plugs) they produce, quod erat demonstrandum.
Pouring “forever chemicals” in the ground is indefensible. If you or your spouse or your children drink poisoned water and became ill, you would insist on compensation and for the offender to be punished. Rightly so.
Not liking a post and/or name calling will not change the facts. Nor will pretending to be a veteran and posting in all capital letters only wanting $5000 in compensation.
