Anybody else find it weird that one of the lawyer working on the case for the lead plaintiff was a clerk for Rodgers? Seems a conflict of interest.
One would think that if you truly worked at Aearo, you'd spell Aearo correctly.
Where are you getting your information that this judge is corrupt? That's a pretty bold statement.
I work at Aero and the earplug is garbage, we knew it was garbage but 3M saw gold with it. Thats why they spent the cash to protect the patent thinking that Moldex was going to reproduce the design. It was an off the shelf purchase from the military, thats why there is no government contractor protection.
And from what I have been read on about the whole MDL is that a Veteran brings up a claim. Its up to the Attorney to screen the case for legitimacy. If they Lawfirm wants to take the case it gets put in the Admin Docket (placeholder). They plaintiff doesn't need to start producing any "facts" until the case gets moved to an active docket and then it goes into a discovery phase where the evidence is gathered. The law firm can drop the case for lack of strength at anytime. Pretty much once a firm pays the filing fee then they believe there is a strong case
For the Bellwether cases each side was allowed to pick a set number to send to test trials. Of course each side was going to pick what they thought was the best. The biggest slap to our face was the 3M defense team picked that last $77.5mil case.
The plaintiffs see big dollar signs but they don't understand those mostly are punitive damages against the company awarded by the jury as a form a punishment, a slap on the hand for the defective product. Settlements do not ever include a punitive award. So there is no way that those bringing cases forward should would or could expect an settlement that high.
There more than likely will be a tier system for those with legit cases. Higher payouts for those with more injuries, lower with those less severe. Again exceptions need to me managed by the vets here.
I foresee these getting settled in waves to start putting out the fires. I guess 1500 cases are getting ready for trial, settle those first, and then discuss how to set up a trust to pay out the remainder.
This company is too important to collapse, cr---y leadership across the suited top but the mid-level is where is thrives. Lets the clowns move one, its sucks, they F*&^ up and still get paid but they always take care of each other.
These rumors need to stop, they are going to drive people to insanity. Unless you can produce some solid facts, I suggest we all tone it done a bit.
And FTR, I am more than likely getting laid off after 14yrs.
Most of the 230,000 don't have any hearing impact at all. All a cash grab by the corrupt judge to help the corrupt lawyers. she has not even made them show if they were even seen by a doctor. She has her own motives.
Interesting to see the legal firm reply in this stream. Hate to see a 100+ Year company have to lay off many employees in order to fund an $8 dollar product that may or may not have met specifications pay out huge amounts.
If the trial lawyers dig in, just tell them about the other companies that went into bankruptcy protection and how long it took to get a meager settlement. Call their bluff.
Back of a napkin … $10 billion equally distributed to 230,000 veterans would equal $43,478.26 each (less legal fees, if applicable). Is that a reasonable settlement for a lifetime of hearing loss, tinnitus, et al?
That's so dramatic. If the veterans refuse to negotiate to anything that would keep 3M a going concern, say nothing under 10B....then 3M will go back to the bankruptcy court and take another shot. This negotiating won't be the end of anything most likely.
