3M EARPLUG LAWSUIT UPDATES:
June 13, 2022: Judge Rogers ordered in-person settlement negotiations will begin on July 15, 2022. Judge Rogers issued the order in the hopes of forcing 3M lawyers on both side to “engage in serious and good-faith efforts to resolve as many cases as possible.”

To help push the settlement negotiations, Judge Rogers appointed Randi S. Ellis as special master for the mediation. Ms. Ellis will also be assisted by retired judge Mark Falk and veteran settlement negotiator Ellen Reisman.

Judge Rogers made it clear in her order that full or partial settlement of the earplug cases is critically important otherwise the federal court system will be flooded with earplug trials next year. The order notes that there are now 233,883 plaintiffs in the Earplugs MDL (down from a high of 282,902). If no settlement is reached these earplug lawsuits, these cases will sent back to their home districts for trial in waves of 500 cases at a time.

Our lawyers are constantly asked when will the 3M earplug lawsuit settle? This is the brightest glimmer of hope we have had for veterans to get reasonable settlement amounts in the foreseeable future.

June 1, 2022: Last week, a new case management order selected the next wave of 500 3M earplug lawsuits that lawyers must begin to prepare for trial. So that is not 1,500 lawsuits that need to be worked up to get ready for trial.
This order puts 3M under great pressure and alleviates pressure all at the same time. 3M's lawyers will be under great pressure to prepare this many lawsuits for trial. It is a Herculean task for the attorneys.

But settlement pressure wise, the sobering reality of this order is that there will not be another 3M earplug trial in 2022. So if 3M chooses to kick the can down the road, it can pay a reasonable settlement amount for the cases on appeal to avoid a final ruling and drag this out into 2023.

Our lawyers do not think this will happen. We think the 3M earplug class action will reach a settlement in 2022. But that is just a guess and a hope.

May 31, 2022: As expected, Judge Rodges cut the verdict in Wayman from $55 million to $21.7 million The reason for the reduction is simply limits on punitive damage awards under Colorado law.

May 20, 2022: $77.5 Million Verdict! The final 3M earplug bellwether trial concluded this afternoon and the result was the largest amount awarded to a single plaintiff so far. After a 2-week trial, the federal jury in Pensacola awarded Army veteran James Beal a total of $77.5 million in damages for his claims that 3M’s defective ear plugs caused hearing loss and tinnitus. This award brings the total amount of damages in the bellwether trials to $300 million.

Even if 3m somehow escapes bankruptcy, it will be left in a state where no one would want to work there. The attrition rates are sky rocketing. Young technical folks are running out like they have never run out before. The likelihood of a loophole popping up out of nowhere are close to none. Besides veterans are a sensitive subject in the US. A victory in this case could mean terrible things for their reputation.

The situation is dire and no one in the company’s has seen such circumstances before. To couple that with the incoming recession end associated uncertainty, the future looks dark. Folks with good tech skills have already sprinted out and joined other companies. It’s like the whole universe is colluding against this company. Someone did something very wrong to see this kind of karma.

The only silver lining that the company is getting a silent “layoff” through this attrition, so it doesn’t have to worry about severance pay.

Axe to grind? Are you joking? This is an excerpt from the millerandzois law firm website. It was listed in a JP Morgan analyst report by Steven Tusa. Tusa has been saying for two years that investors don't appreciate the threat from these lawsuits and he mentioned this website as a starting place to keep informed on the 3M earplug lawsuits. Thus far, 3M is paying top dollar legal fees for some very poor quality advice - and getting their lunch handed to them in Federal court. The Feres Doctrine defense has been a bust - 3M's attorney's are grasping at straws. Unless they find some loophole (which, so far, investors seem to be banking on), they are facing an existential threat. In April 2022, 3M hired Steven Reich, an ex-Deutsche Bank lawyer to work out some type of legal scheme for 3M (similar to what he did at Deutsche Bank).

It seems like it’s all FUD from the same person (a lot of the posts sound the same). I was worried in the beginning of the week but the continuous posting all in the same voice has me agreeing with the poster below that it’s probably an axe to grind.

I’m not sure why someone wrote this pretending to be an attorney. It was clearly written by someone with an ax to grind who is taking great pleasure in 3M’s struggles. But the true reality is, most of the people employed today at 3M had nothing to do with the decisions that generated this litigation. They are innocent victims who may be the collateral damage of the unethical or ignorant choices made by others.

Why go to such elaborate lengths to shove more fear in the faces of people who are already worried sick about how to protect their homes and families?

If it gets as bad as people here are predicting, that is sufficiently terrifying without people standing on the sidelines applauding.
