Appeals court upholds Biden vaccine mandate

I think it’s all over but the crying now. Federal Appeals court reinstated President Brandon’s vaccine mandate. a small summary:

“A federal appeals court has reinstated the Biden administration's vaccine and testing requirement for private businesses that covers about 80 million American workers.

The ruling by the 6th U.S. Court of Appeals in Cincinnati lifted a November injunction that had blocked the rule from the Occupational Safety and Health Administration, which applies to businesses with at least 100 workers.”

Private companies with over 100 employees will require COVID vaccinations by Jan 4th or weekly Covid tests. Since we already know Walmart is not going to pay for weekly tests or give time off to get a weekly test, that probably means you either get the shot, pay for a weekly test yourself or voluntarily resign. By the way, if you are let go because you won’t get the shot, there’s no unemployment insurance.

Interesting dilemma, yes. A good test of personal rights, states rights and federal over-reach.

The smart money is saying Walmart will drag its feet the first couple of weeks in January, but, in the end, Walmart will require the vaccine.

Unfortunately, with the new variant running rampant and numerous indications that it’s going to continue, plus, expected new variations on the horizon, the high court could very well uphold the mandate as an unforeseen public safety emergency. It is a compelling argument if you look at the COVID rates over the last 12 months.

Personally, I’d rather see them give a $5000 tax credit on your 2021 taxes if you’re fully vaccinated. I think offering that much would be a strong incentive to anyone and could swing the tide to get us to herd immunity.

The plot thickens. Since the Supreme Court will now take up the case, we’ll have to see what happens before the January 4th - 7th date range. They could put a temporary halt on the mandate while they consider the issue, or they might not. In any event, there won’t be a final decision by the deadline. There is some reason to believe they would easily and quickly uphold the mandate for health workers that have a funding source tracked back to the federal government. In that, if you’re paid by the govt and the govt wants you to do this, then it could become a condition of continued employment.

The private company issue is more complicated, because now you’re stepping on individual and states rights, as well as setting precedent for other emerging medical/health related topics, such as sterilization, implanted chips, bar codes…… all of that is coming in future years.

Could the federal government require everyone to give a DNA sample? Would the federal government use DNA data to make hiring decisions?

How would you like your new baby to have a chip implanted in them before you went home from the hospital? They do that with dogs and cats already.

The point is, the vaccine is a medical/health procedure. If the government can require this, what else can they require?

It would be interesting to see if they refuse to hear it, or take it up. I just think it’s unlikely they will overturn the mandate.

I think if I was working at Walmart and wasn’t vaccinated, I’d be as jumpy as a long tail cat in a room full of rocking chairs. This situation has “bad ending” written all over it.

Actually, wouldn’t it be more likely for the Supreme Court to refuse to hear the case? That way they could let the 6th circuit decision stand.

Given that, generally speaking, almost all DC and store workers do not work outside or from home, the only choice left for them is 1) weekly tests and wear masks, or 2) get the vaccine, or 3) voluntarily separate.

The high court may see this as a states rights issue and refuse to hear it. Most likely, though, they will take it on and refuse to block it. There is some case law for this type of thing, already.

The ETS does not require anyone to be vaccinated. Rather, the ETS allows covered employers—employers with 100 or more employees—to determine for themselves how best to minimize the risk of contracting COVID-19 in their workplaces. Id. at 61,438 (allowing employers to “opt out” of any
vaccination policies). Employers have the option to require unvaccinated workers to wear a mask on the job and test for COVID-19 weekly. Id. They can
also require those workers to do their jobs exclusively from home, and workers who work exclusively outdoors are exempt. Id. at 61,419. The employer—not OSHA—can require that its
workers get vaccinated, something that countless employers across the country have already
done. Id. at 61,436 (“[T]his ETS offers employers a choice in how to comply . . . .”).

The Supreme Court will decide if they are going to intervene. They don’t have to. In fact, they can reject the case, consider it at a later session, or chime in now. Court watchers believe they will take it on immediately, but they don’t have to.

The Supreme Court has already refused to overturn the New York Health Care worker mandate, which doesn't even provide for religious exemption. This conservative court voted 6-3. Think about that.
