PepsiCo Vaccine Mandate Question

How is PepsiCo dealing with employees in states with LAWS (apologies, but I don't want that overlooked) protecting them from mandates by means of allowing employees the option to vaccinate or test weekly, provide proof of antibodies, etc?

How is it ok to force one group of employees (salary) but not another (hourly) to be vaccinated? Don't we all breath the same air? I how can that be legal? Both groups are working in the same building.

Due to the Supreme Court’s recent decision to block OSHA’s Emergency Temporary Standard, while our current Company vaccine mandate for salaried exempt associates remains in place, we will not be proceeding with additional vaccination mandates at this time.

People need to understand that this is not a layoff...it's termination if you don't comply. The amount of discrimination going on is unbelievable. For them to now offer testing to those who are hourly but NOT allow it as an option for those salaried exempt is discrimination. Those who are being offered religious/medical accommodations are also being discriminated against because those "accommodations" come with a string attached which is weekly testing. If you didn't know...when they "require" weekly testing for those receiving a religious accommodation but not also "require" it of the vaccinated at the same level - you are being discriminated against BECAUSE of your religion! This is a violation of Title VII of the Civil Rights Act of 1964. If you are one in which has received an accommodation with the stipulation, then you also have the RIGHT to file a formal complaint with the EEOC for discrimination. In fact, attorneys are recommending that you do so. I would also suggest that you file a complaint with the Speak Up line. You can do so anonymously and it will trigger an investigation just as it will when you file a complaint with the EEOC. The fact that they "require" you to designate a religion on their accommodation form is also against Title VII. No employer has the right to request you designate a religion. Under Title VII you can also request accommodations for conscientious objection to getting the vaccine. Read up on your legal rights folks. And make sure to connect with those within the organization who are fighting this battle. Most of us are not against folks getting the vaccine...rather we are FOR medical freedom for all without the threat of losing our jobs. You are not alone in your fight and there is strength in numbers. Don't be pressured or bullied into making a decision that you don't believe is right for you. Make sure you get things in writing. Ask the questions...in writing...that way you are covered in the event you need to take legal recourse. There is lots of information out there - you just need to know where to go to for support with those that feel the same. Everyone should have the freedom to choose what is right for their health WITHOUT the threat/coercion of losing your job. Those of us who are fighting do not deny that this virus is real, nor do we deny that it is serious. We just want to have the freedom to make the choice of what goes into our body without the threat of losing our job, just as those who made the freewill choice to get vaccinated did without losing their job. All of us are essential to the success of this company, regardless of your role.

the company is paying for testing. if they don't offer the testing option and pay for it they will have no Frontline employees.
those that don't have the vax are not scared they are just making a choice not to put something in their body like any other vaccine.

I don’t think Pepsi will pay for the testing. That expense will fall on those who are afraid. The shot is free and not dangerous, the disease is actually quite dangerous. Why would any company pay for a persons illogical and unnecessary expense? By the way, all of the salaried are getting vaxed despite all of their blathering.

Scare tactics and encouraging talk/incentives are supposed to funnel employees into getting vaxxed. Or that's their hope anyway. As other posters have stated, the Frontline workforce has always a slippery slope. Mandating vaccinations could cause a huge void in the backbone of the company whether it be through voluntary resignations or forced terminations.

When the vaccine is available for free, what's the point in wasting $$$ in testing so many workers, that too weekly, who know how long. Just put bonfire on all that unvaccinated trash and replace them with automation.

Just over a week of employment left. How could you justify getting the clot shot, for a company that might get rid of you next month in another reorg, without batting an eye? They deserve all the problems coming to them in the near future.

the plan is to do weekly testing for the hourly/non exempt. They haven't annoucned it yet. I assume if the mandate from Biden gets shut down, then the weekly testing won't happen.

They are not doing weekly testing at the plants or at least not where I am at. Believe they are going to leave it in limbo unless Biden can legalize his mandate. Like the other comment, they can't afford to lose all these frontline with the turnover and Hobby Lobby paying $18.50/hr.

So a “separation agreement” would be a buyout? If that were actually communicated in some fashion, there would be some takers for sure. The age discrimination agenda could possibly be advanced. No policy, just a decree, it’s amazing how far our company integrity has slid. Pretty soon we will decree this down to the front line, and then we will be decreeing to an empty room.

Associates will be contacted personally by HR no later than by end of the month December to determine/ask if they plan to be vaccinated or not. Associates will have until first week of January to comply. If not, separation agreements will be drafted and presented to Salaried exempt associates no later than January 28 which at that point termination would be effective immediately. PepsiCo is taking a hard stance for all Salaried exempt associates.

I haven’t actually seen a written policy. All I saw was talk about parting company with non-vaxed employees. First time I’ve ever seen a policy where an employee can be terminated without anything in writing. Highly unusual and confusing.
