Seriously ? Quite a few of my RE friends have “glided” into NSI and forced retirement, both last year and this year. I’m talking about individual technical contributors, recognized company experts.

I know many people who were successful pre-merger including many at MRDC in Pennington, NJ. They were all rolled up in to a class action lawsuit and were pleasantly surprised at the result. No NJ court had any sympathy for Mobil back then. Those lessons learned are the reason for the current NRE policy.

Given the safeguards on PIP for NRE and glide paths for RE's, seems that its more youth discrimination than anything else. I'd guess that 80% or more of employees currently under the age of 50 will not get a pension for one reason or another.

@hua A case like this would be litigated in federal court. Unlike third-world Texas, federal judges are more qualified and take the law seriously.

That said, the chances of winning such a case against XOM are nil, with the possible exception of class-action. Even then it’s a long-shot. The XOM legal team has decades of experience with grinding down their opponents in court using costly procedural maneuvers. XOM will likely appeal any ruling made against them at the district level, knowing that the ruling will be watered-down or reversed entirely by the 5th Circuit.

In 1985, someone won a case so XOM modified its performance appraisal process and created PIP.

All XOM has to do is make a small donation to the judges on the TX Supreme Court and they can have any age discrimination case dismissed:
