Can you be moved bc of a medical accommodation?

I don't want to be too specific.... But long story short, I have a medical accommodation restricting my hours/days to the base hours. My position is a base 20 budgeted hours. I have this accommodation because of a medical condition. My position in the store is unique; there is no comparable position. The VPSM said she'd move me to a selling position and hire someone who could work more hours except that I'm "valuable." She's also asked if I could talk to my doctor about loosening my restriction. Can you be moved to a non-comparable position because your restriction irritates people? (Mind you, I'm restricted to my fixed base hours which are already part of the job.)

OP. No MBA. They quit, like the others before them. I am quite accustomed to being alone. It is true that it's at-will but I've never once seen that exercised. It's funny, one day I'm told that I would be able to keep to twenty hours on the selling floor; next day store manager is screaming that the part-timers won't pick up shifts. I think ultimately I am going to speak to HR about these "theoretical" questions. I just don't see how moving someone with an excellent record of performance (don't forget I've spent months without an ASTS or MBA) because of a medical problem breaks no rule. I'm just so scared about inquiring because if it gets back to the store manager, my life will be absolutely living h–lI've seen it before.

Thank you all for your advice, but at this point I believe carefully asking HR is the only next step for me.

Unfortunately the words “at will employment” come to mind. No jobs is guaranteed and no one is owed a job.

Can you do your 20 hours any days of the week needed? Honestly, AST has moved away from base rotation schedules, especially since the AST Supervisor position was eliminated. You said you don't have a "supervisor", your store doesn't have a MBA? The AST is the right hand of the MBA and needs to help cover the office when the MBA is off, and those days off aren't the same each week. But if you get moved to "another job" who is going to do AST? And I can tell you a sales floor job is going to be even more stressful. You need to get a firm answer from Macy's as to what can be done to keep you in your current position and for how long your accommodation can be authorized.

OP. Alright I will give details even though they are identifiers. I am an AST. I perform my job past expectations. At times, I have functioned for months with no supervisor: meaning no one but me in the office. So I can assure you that I do my job 100%. My issue is that I have epilepsy and too much stress/sensory overload could aggravate my condition. My medical accommodation is to reduce my week to four days, with my twenty hours divided up. All I've asked for with my accommodation is to work my schedule option hours in four days. I can do my hours. They're mad because I can't do extra hours beyond my base. Moving me to a position that's not comparable in any way still won't change this problem. I just can't find any written policy about being moved. I'm scared to put in a case because they might notify the store manager and make my situation worse. She's already asked me to talk to my doctor which I don't think should be allowed.

  • Really, at this point I'm just venting... I'm not in a good place and without clear written policy, I'll be shot down for sure. I was just hoping someone knew how I could locate more info because it's rather brief and general on AskHR. I know that no one can really help me... I'm not blaming anyone here except myself. I'm sorry.

If your hours are guaranteed and your condition does not allow you to do your job because of restrictions, then the company can move you to another position where you are able to work, it's all about accommodation. I'm guessing you are just an hourly associate. So they can move you to another area temporarily. However, If you are able to perform your duties with no issues, I doubt they can legally move you just for any reason.
A few years ago, I managed sales support. A sales associate had done something to her foot and had restrictions where she had to stay off her feet. The company moved her to my area where her restrictions were accommodated. After a couple months, the restrictions were lifted and she returned to the sales floor.
Contact HR to get a better idea on your situation, since you are not wanting to give specific details here

Hello. OP again. I just want to add that I believe my accommodation is reasonable because it restricts my hours to my actual job option hours. I don't think it is fair to be threatened to move simply because someone wants more hours than my job option gives. I can't find any specific policy on changing positions in the ALDM documents on AskHR.

Hello. I work in the office and the amount of hours are fixed. I can do my job. It's simply that my accommodation is considered an irritant and inconvenience.

It depends... if you can no longer do your job because of your restriction, yes they can move you.

However, i dont know of any position that is guaranteed fixed base hours
