Just returned from maternity leave to discover that I was demoted from a represented adjuster to an unrepresented adjuster. No one even had the decency to discuss it with me. Just said: here’s your new manager, have fun! I can’t believe I ever gave this company a moment of my time!

If Allstate had such a need for someone in that role then perhaps they shouldn’t have laid off half of the dept. just 2 months earlier.
The worst part of that is that you know have to deal with whiny injured parties directly instead of through their attorney. Sometimes it's really satisfying to deal with an attorney because they are not emotional and you can be brutally honest with them..... like, why did you take this file? there's a scratch on your clients rear bumper and the meds are obviously not related. You're not getting squat from me, good luck with a lawsuit, you will lose your shorts.
Don't believe everything you read on the internet.
Legal move by Allstate but still a scumbag thing to do 🙄
I know many former teams are no longer so that they can now do ‘chat.’ And they have pulled people from other departments such as quality (CEC), TDY’s and such for the ever growing demand of chat volume.
OP sorry that happened to you, but you are responsible for reading and understanding what FMLA means. There is nothing an attorney could do BECAUSE FMLA, STD LTD are all explained in your benefit information. Allstate always has attorneys to make sure those type of issues are addressed in writing
If you file FMLA Your job isn’t “protected” just a position within the company.
While Allstate is a horrible, awful company based on what OP is saying Allstate met their required obligations. As long as they have protected a job in the same department for the same pay that is all they are required to do. Sure this can be seen as a dirty thing to do but the business must be run even if you are out having a baby (congrats by the way). Maternity Leave does not garner the same protections as FMLA or other types of leave as having a baby is considered a life choice and not a medical hardship choice. I do suspect however that a company that actually cared about their employees would have placed her back in the same position and applicable band.
Not to be extreme, but this sounds like a lawsuit in the making
Doesn’t Fmla protect your position while you’re out?
Talk to an attorney. Represented means a claimant gas an attorney. Unrepresented means they do not have an attorney. Personal or bodily injury claims.
Two women in our department got demoted from coaching partner back to front line about 6 months apart after maternity leave. The position from HR was they have to protect a job in the department but not necessarily the job. In both cases department leaders said there was a need for their position in their absence and when they returned they were seated in front line service in place of the new coaching partners that replaced them.
Additionally, I’m now at the top of the pay range for the lower position and won’t get a pay increase now matter how well I perform.
The band still applies to the lower role. However, work is different and no one else was moved. The team I had is the same. I worked to get into that higher position and my job is suppose to be protected while on leave. -|-🏻
It means if the injured party is represented by an attorney or not, most claims departments use this term
That's c-appy.
BTW, what does the word "represented" mean in this context?
Was there a reduction in your pay? Is the job/duties comparable to pre maternity leave? We’re others also “demoted”.
