Is anyone as upset as we are in our store about the newly mandated sick pay/leave? Since it is a new state NY law, why was our PTO reduced? So they don’t have to give us anything extra because they are so generous! Several colleagues are consulting lawyers to see if this is “legal.” Any thoughts???

He probably could, but may have a conscience and understanding of policy; Sick/PTO. Better to be able to allow management to schedule to availability than workaround of call outs. But in the end, “because he’s part time flex, not?” Modern day oppression. Yes, you have a job, part time and we’ll squeeze a bit of of government required benefits. Read between the lines though, you cannot use them as you see your full time counterparts can. And during high season you may work as many as 40 hours. During the retail doldrums afterward, expect few.
Can't he just call in and fake sick? Ast doesn't usually ask for a Drs note the day after
I'm an AST in CT. We have a flex who wanted to use his huge amount of sick time, 12 hours, before the year was up. He was told no bc he can only use it if he's really sick. Yet we have dinosaurs with 5 weeks of vacation giving themselves a 6th. I fought for this kid even though they kept telling me "It's the policy" over and over. On MTO it clearly states that the time is sick time / PTO. I pointed out the PTO part and then they changed it to "oh, he's flex, he's not allowed." Ultimately I won the fight and he got it. I know I'm right bc the 40 hrs is "carved out" but I can't for the life of me find the policy on it. Again, I'm in CT. Anyone know where to find it?
To the poster below. You may use sick pay for any reason at anytime with no notice. You cannot be penalized.
And if one calls out 5 times for sick pay, any demerits? Tough to plan illness, but if I have 5 PTO days I can plan accordingly. Sometimes denied, but easier to deal with than diciplinary action.
As an FYI there is no loss of time however sick time is not paid out if you are laid off.
To the original person who posted this absurd question, PTO is not a requirement, it’s a benefit. Trust me, they are doing exactly what is legal, stop trying to act so tough and threatening with your bulls#it lawsuit threats. Every Sick Pay laws allow this!
Yea. It’s actually better. You can use the sick days for any reason at any time. They can’t deny you taking them off. It’s like PTO but way less restricted. During key days, with no notice, etc
It's the same amount of days. Just worded differently. You can use them anyway you like
Welcome to California it’s been like that for years now here.
When government mandates a minimum amount of PTO or other benefit for everyone, those who make excess of that get their hours and compensation taken away in favor of those who didn't meet that minimum. It's a story as old as time. The same thing happened when Obamacare came along, everyone under 50 had their premiums massively raised in favor of everyone over 50, while all the mandated benefits for those working over 29 hrs a week turned everyone into part timers. Congresscritters who've only ever spent other people's money always think there's a free lunch, but it never works out that way.
It is legal. They don’t have to give you vacation/PTO. That’s a luxury benefit really. They did the same thing in CT years ago. Macy’s is slick and converted a week of regular PTO into sick time. However, if you do it use the sick time during the year, they will let you take it as PTO in January. At least in CT they did. It s—s and a good company would add another week. But most can’t or won’t. Just the way it is. Be glad they are still giving PTO.
