My husband is out on leave. He got hurt but it is not a workman’s comp thing. He’s been out for 8 weeks and will be returning in about 2 weeks. He’s now being told that they are posting his job because something changed and now they only have to hold your position for 2 weeks! He was told they to give him a job at equal pay and rank when he gets back but not the same job that he already knows how to do. It’s always been that they held the position for 90 days, then they would post it. Has anyone else come across this?

FMLA is up to 12 weeks, I was on it a few years ago.
My store held my job, which they were not required to do.
Others are correct that the return is not necessarily to the same position, but a new position must be equivalent in pay and benefits to the original.
The was no change or 90 day time line according to the federal guidelines. He just has to return to an equivalent position, i.e. pay, title, and have his benefits restored by law. May not be the most compassionate move but what the protection calls for. And I’m not a Lowe’s policy guru but it seems unlikely that they Would add stipulations to bind themselves further than legal requirements.

FMLA only says you have to be given an equivalent job, not necessarily the same job. So they’ve actually done nothing wrong in this case.
As long as it'sthe same pay, nothing you can do. They are not going to hold the position forever.
Its 90 days as far as I know. As long as he is on fmla legally they cant do sh–!

They cant do that while hes on leave. Even if it’s true, they would have to stick to whatever the policy was when he went on leave.
