It varies by state. In Illinois, severance is not considered current wages, but rather income for time previously worked so you can collect unemployment effective your separation date.

True, I assume every state is different, In my state it is not permitted. Great call for the person that wrote that first comment and left out that it differs by state. I do not know, but I cannot imagine it is legal in a lot of states, that’s like double dipping. If it were legal here, I would run to hop on that train.

It’s funny how someone who worked in the state dept of unemployment has ZERO idea that each state handles UI benefits/severance completely differently. 🤔 🧐
If YOUR state of residence handles severance as wages that’s where the diff is. Also if the severance included a release of claims document you had to sign that’s the means to collect UI concurrently (if you’re state allows).
Yes. It is not illegal in Ca to collect unemployment plus a severance. Please know what you are talking about before spreading misinformation.
It is illegal to collect unemployment until your weeks of severance run out. If you received 10 weeks of severance, you cannot file until week 11.
Unemployment will approve you earlier than that based on what you tell them, they will even pay you...BUT it takes weeks to get your payroll records from your previous employer, once that happens you will be caught and it is a felony. I used to work for the state unemployment office and this was my department
