Thread regarding Pratt and Whitney layoffs

WARN ACT

Does the WARN act apply here for a 60 day notice? If they're planning on laying off over 10-20% which I expect, that would put them over the 500 person WARN act trigger. Unless they're planning on having multiple smaller layoffs to skirt around it

To answer the severance question. I was laid off on7/29/20. That was my last day working. technically on the payroll until 9/29/20 due to WARN Act but not working. They gave us our 10% pay reduction back too. Also a transition payment that is based on years of service. I will get $6k and also 1 weeks pay for each year of service paid bi weekly until it runs out with the 10% back as well. Medical is the same. Covered until the severance runs out. After that I will use HSA to buy a plan. They provide an outplacement service and tuition for a year. I hope all that makes sense. Please let me know if you have more questions. Hang in there!!!

PS - I also qualify for unemployment after 9/29 (Need to put Covid as the reason for lay off to qualify for the extra unemployment $$) and they owe me 350 vacation pay. Gonna use that money to pay off my car.

If I may ask, as I'm sure everyone is curious to know, can you please share what the severance package is like?

Thanks everybody for the kind words and concern. I was at Collins Aerospace in Chula Vista. I had a great career and will be ok. The part that hurts is that it was like getting a knife twisted in my gut. I sacrificed so much for the company and the just got B–ch slapped in the end. The sent me my stuff via FedEx in 2 boxes. No thank you, no retirement party and I’m too old to find another job at that salary and 2 young to collect social security. Thank God for my 401K, pension and unemployment. I’m seeing this as an opportunity to finally do something I love (for way less money). I’ll never do the Corp thing again. If it happens to you, see it as an opportunity for a brand new beginning and ax a gift. We only live once. Time to smile each morning knowing I can now live my best life. Best wishes to all of you. If it happens, it will sting, let it snd them move on. Life is way to short to spend our energy being pushed off at a ruthless, new leadership team. Hugs

To the individual laid off below. I’m sorry that happened, this whole thing is a mess. When did your lay-off happen?

Sorry to hear of your lay-off. Where are you located? It seems like employees with years under their belts in management are the ones that may be hit.

To the person with plenty of meetings and work on their plate. THAT WAS ME TOO!!! I was working critical projects, 10-12 hour day’s, above average reviews and BAM, rug pulled out from under me just like that. I had 30+ years with the company and was in management. If you are older and making a nice wage......you will be a target....”the company” does not care.......

I think if the severance package is equal to 60 days of pay then separation can happen immediately. I

The fact that there have been no layoffs at Pratt and whitney connecticut is quite perplexing under the current circumstances the industry is facing. it seems they have been stalling and delaying the inevitable. Very difficult to get a feel for the truth on this topic from anyone in the company but would say it has to be before the 4th quarter

They said we were going to have a layoff in the communication flow down. They just didn't tell the employees who were getting laid off so they could look for work and prepare in advance of the layoff. The law must have some clause attached where they don't have to. They would never allow anyone to work on anything in that case due to risk of sabotage. Any employer would feel that way legally.

For New Jersey:

https://www.littler.com/publication-press/publication/new-jersey-warn-act-covid-19-amendment-pending-radical-expansion-law#:~:text=On%20April%2014%2C%202020%2C%20Governor,from%20the%20COVID-19%20pandemic.

Executive Order 103 was just renewed for another 30 days, thereby giving the January 2020 NJ WARN amendments a tentative effective date of Friday, December 25, 2020. This effective date will be further delayed if Governor Murphy further extends Executive Order 103.

You need to look at your state rules during Covid-19. For NJ, Gov Murphy signed an executive order to protect the Employer and not the Employee. The 60 day rule was waved.

Do a google search.
https://www.jdsupra.com/legalnews/covid-19-new-jersey-amends-the-nj-warn-65653/

"Accordingly, where the COVID-19 exclusion applies, employers need not comply with the mini WARN Act’s notice requirements nor provide severance for a COVID-19-related mass layoff once that provision is in effect."

https://www.natlawreview.com/article/fall-approaches-warn-act-lawsuits-likely-to-heat

Although the WARN Act requires employers to give as much notice as is practicable, there are times when no notice is practicable and the notice period may be eliminated, which a court determines on a case-by-case basis.
