Lowes Refusing to Comply with State Mandate about masks for either customers or employees

Lowes believes they are above the law.

Same thing happening here in Maryland.
A long letter/email has been sent to County Exec - Johnny Olzewski, Baltimore County Police and Governor Larry Hogan - asking that the store either be forced to comply, be forced to close or have the store manager arrested.

And looking at the noon news it looks like they are aware of this issue.

It's b—s—, they force employees to wear masks threatening of write ups if they don't comply but then bend over for anti maskers. They don't care about the law.

A Lowe’s shopper in California said another customer repeatedly spat in his face when he told the man to wear a mask, according to a lawsuit filed against the company that claims Lowe’s workers refused to intervene.

John Birke went to a Lowe’s Home Improvement store in the Los Angeles neighborhood of West Hills June 28 to buy an elevated toilet seat for his wife, according to his lawsuit filed July 16 in Los Angeles County Superior Court.

Birke spotted a maskless man in the aisle he needed to enter, according to his lawsuit. From at least 40 feet away, he asked the man, “How did you get in here without a mask?”

When Birke asked again, the man cursed and told him it was none of his business, according to the lawsuit.

Birke then asked Lowe’s workers to tell the man he was violating California Gov. Gavin Newsom’s executive order requiring the wearing of face masks in all public places, Birke said in the lawsuit. When the workers refused to do anything, Birke said, he called 911.

Seconds later, he encountered the maskless man again. The man came within two feet and spat in his face “four times in rapid succession,” according to the lawsuit.

“This attack occurred about 15 feet from a Lowe’s employee, who told the attacker, ‘You just spit in his face,’ yet did absolutely nothing,” according to the lawsuit. “In fact, no Lowe’s employee so much as asked Birke if he was all right.”

The lawsuit said Lowe’s failed to protect customers’ health in its stores by allowing in shoppers without masks, in violation of public health law.

Birke wants a jury to award him at least $20 million, according to the lawsuit.

A Lowe’s spokeswoman told The Charlotte Observer Thursday the company won’t comment about pending litigation.

At the time Birke filed his lawsuit July 16, he said, he continued experiencing symptoms “possibly consistent with COVID-19 infection.”

Birke told the Observer Thursday that his COVID-19 test results came back negative for the disease this week. He said he was wearing a mask supporting Joe Biden at the time of the alleged incident.

On July 17, Lowe’s announced the company would make all customers wear masks in its U.S. stores effective July 20.

While supplies last, Lowe’s will offer free masks in all stores to customers who need them, CEO Marvin Ellison said in the news release announcing Lowe’s mask mandate. “As a retailer offering essential goods, we have a responsibility to our associates, customers and small businesses in communities nationwide to help provide a safe shopping experience,” Ellison said.

On Tuesday, the day after its mask mandate took effect, Lowe’s told the Observer that due to safety concerns, the company won’t let its employees enforce the mandate.

A handful of shoppers complained to the Observer and on the Lowe’s website about the lack of enforcement of the new mandate.

“We will not ask our associates to put their safety at risk by confronting customers about wearing masks, so we are consistently requesting that customers wear masks for the safety of everyone in our stores,” according to the company.

Calls to your Health Department are anonymous. Enough calls and they'll send a rep in to observe. Then the documentation begins. Shortly thereafter, days maybe, law enforcement arrives with a shutdown order. I know this from experience. Give it a try. You won't be disappointed.

Lowe's doesn't have any managers with big enough balls to enforce the mask policy for customers. They expect us to suffocate through a 10 hour shift while they get to hang out in an air conditioned office without a mask!

In my store, the associates are much worse than the customers. As soon as the doors are closed, or they go into the training room, receiving, or customer service, or even another aisle, the masks come right off. Almost every associate in my department takes their mask off the second any customer walks away, even if another associate is standing next to them, like they are all immune. They almost always forget to put it back on with customer comes up to them. I guess I can’t expect much when none of the managers wear their masks either. Can’t enforce sh– if we don’t do it ourselves. I just make sure I take pictures so if I get sick my family can kick their a– is in a court of law.

Some of the Walmart's in my area have off duty law enforcement at the main entrance (all other entrances closed) to provide that subliminal compliance message to patrons. Would like to see Lowe's issue a "no mask - no service" mandate but know they won't. Many of the patrons that I encounter that refuse to wear a mask (even though it is mandated by our county) will also get right up on you and you are forced to keep backing away. Don't care what your personal opinions are but that doesn't give you the God given right to get up in someone's face that is wearing a mask. Non-believer, fine, just stay the frack out of my face and preferably out of my store.
