To the person asking about a class action: anybody can petition a judge to convert their already filed lawsuit into a class and hope that the judge does it. Of course, if you are looking to sue because you won't get severance, good luck since severance is not guaranteed by any employment laws. Doubt the suit would last long enough for you to request a class.

If you are hoping somebody else "files a class" because you don't want to bother but you want to ride along, well, it speaks volumes...

As an outside observer, I am curious as to who is getting these "emails". Are they going to the front line Cashiers, shelf stockers, truck unloaders, etc.? Or does this mainly apply to head office-type corporate people?

more stores where told they were closing yesterday as well. They are only opening stores to liquidate them. My store reopened early May 2 weeks later we were told we were closing. I think they are reopening stores as they get liquidators lined up to close them

just received an email that it is extended until september 8th. guess that truly means the end of transformco. bridging so many months at once only gives the prospect that the company is over and looking/applying for a job is required. they screwed all current and potential employees along with any hope they had for saving grace in media, print, blogs etc. sears/kmart/transformco is done. glad eddie escaped paying us like he should have but hey. he’s the next epstein, good luck when you’re in jail

Yup just got the email. They are not even trying anymore and just copy and paste the same message and just change the dates. Better off just looking for a new job folks because there won't be one when they'll just close down the stores before you bringing anyone back.

Yep, they just sent out an email. Cowards are too selfish and afraid to fire everyone they don't want, and they want you to quit so they don't have to pay any severance.

If you haven't been called back yet - you are not needed, and likely you won't be called back. You have been fired, but not formally, as to avoid severance.

Can employees form a class action?

As we communicated on May 26, 2020, we anticipated the furlough to last at least through July 1, 2020. As COVID-19 continues to significantly impact our business operations, we are extending the furlough through at least September 8, 2020.

Please keep in mind that some associates may be called back to work sooner on an as-needed basis.

While we realize this is not the news we had hoped for, these are difficult decisions we are forced to continue to make given these unprecedented times. We are continuing to reopen stores but there is still a lot of work to be done.

Furloughed associates will continue paying premiums at active associate rates for continued participation in medical, dental, vision, optional life insurance, long-term disability, accident and critical illness coverage.

As a reminder, you are eligible to take advantage of unemployment and other state and national relief programs where available while on furlough. In order to assist you in applying for benefits that may be available to you, please reference www.dol.gov or call 1-866-487-2365.

We expect to provide another update in early September.
