IBM is discriminating older employees

IBM is a discriminating company. At the same time they RA older employees they are hiring summits.
I think is great they are hiring people who just graduated college, they are the future. However, they should not RA amazing employees. This is open age discrimination that has been going on for several years. I think the government should do something about it. What can we do?

I can tell you that this is a lie. The front line managers do NOT make all decisions about who gets laid off. In my organization, the front line managers were circumvented, ie NOT consulted, but asked to do the dirty work of delivering the bad news. They kept a lazy young person who couldn't code and wouldn't try to learn, while they fired an innovative, inventive, and productive veteran with many accomplishments and patents. This was not an isolated incident. Please do not take this as a generalization that all young people are lazy or all older people are accomplished and productive wizards. That is not so. However, the decision makers aren't the line managers here, and performance isn't the deciding factor. I wouldn't trust a thing the IBM lawyers say.

They are absolutely targeting older workers. They fired one of the best engineers I've ever seen, with amazing contributions to the organization. And they chose to keep those with lesser skills and contributions. It's blatant ageism at work.

Tell that to the hundreds of band 6-7s in US Federal who just got laid off. Or the hundreds of mid career professionals who got laid off in the Europe redundancies to save bloated executives and senior staff who do nothing.

True, They discriminate older employees and a minority of them are filing a complaint to the EEOC before being authorized to sue IBM. So, IBM plays because laid-off employees (50+) bend their backs and keep it quiet. If IBM is laying off 4,200 people in US as it is said and 2,500 complain to EEOC, then this will end capturing the attention of the federal agency. Until then, IBM plays and it is a win.

Yes, they RA in one division, then they open the same job with different titles and hire summits.
Go to the offices in Dallas and Atlanta. All you see is summits.

I’m a manager. Older people are not paid more at IBM. Salaries for my new hires are higher than most staff with 10+ years tenure. Even new experienced hires come in with salaries roughly 100K more than my in house experienced hires. I have pushed to equalize, by the way, and my management has repeatedly refused to address it. Layoffs are disproportionately affecting older people because the average age here is much higher than at other tech companies. You’ll see the same demographics in layoffs at Cisco or Oracle or Intel.

They have also been known to RA in one division and hire for the same job as the departing person but in another division. Could that be proven as discrimination against the older, higher paid employee?

RA is a resource action. It pretty much means the same things as fired, reduction-in-force, layoff, etc.

so i have seen that some higher bands are part of this RA, and they will be replaced by younger workers on lower bands, so its not redundancy it cost cutting. Not sure that is legal in a lot of countries
