I’d love to start a collection of OWBPA tables provided to those layed off by Xerox. The anecdotal evidence is clear regarding discrimination but having a fuller view into what has been done is necessary to determine class action viability of success, before expensive discovery. Ideas? Interest?

From https://dhr.ny.gov/faq. Xerox will petition for a no cause dismissal if you sign the release. Doesn’t mean they will win.

If NYS provides free legal representation for age discrimination lawsuits please share how one would go about getting this free representation.

Keep in mind that most of us have been replaced by someone in a different geographic location. That’s not age discrimination.
Amazing how XRX mgmt is trying to discourage action like this by commenting on this board. Many states including NY will assign a lawyer at no cost to fight the complaint. Also xerox will not fight all cases especially when they are individual and not class action, as they actually save money with reasonable settlements and don’t want the press associated with court Judgments not in their favor.

Sorry, 35 year whiner, I’ve been with Xerox longer than you. “Millenial”, lol (oops, yet another perplexing acronym) . Speaking of reading comprehension, understand the difference between intra-company terminology and widely used phrases and acronyms. Or do you expect others to spell out the meanings of USA, TGIF, EBITDA, PC, IBM, .... the list goes on. Take a class, and learn how to use a search engine.

You've been at Xerox 35 years and haven't yet figured out how to use google to search for broadly used acronyms? Here's a hint: if search doesn't turn up an obvious meaning within about 10 seconds, THEN ask the OP what they were referring to. (And if you don't know what "OP" stands for, go back and re-read the hint.)
And people wonder why "older" workers are getting laid off. Maybe it's not that they're old, maybe it's that they have let themselves become technologically lazy (or worse).
First - spell out the acronym., then use the acronym. In my 35 yrs at Xerox, people STILL don’t know the proper use of acronyms.
Google age discrimination lawsuits & read some of the articles outlining the impact on people’s lives. In order to win you will need to prove that age was the driving factor in your dismissal. If your job was eliminated, outsourced or offshored then your age was not the driving factor. Xerox will appeal any favorable decisions all the way to the Supreme Court meaning you will be in this for years and you will spend a lot of money on lawyers. The financial and emotional toll will be high. A background check by potential future employers is likely to turn up the case. This could result in you having difficulty finding future employment. If none of that deters you then by all means file a lawsuit but count me out. I just want to get on with my life which truthfully is just fine without Xerox.
People who say let’s sue have never tried it. I had to walk away from a $1m commission because my client decided it was too much and refused to pay. I had a signed contract and delivered a $35m deal. Lawyers wanted $100k to start. XRX will be bankrupt by the time the suit was concluded anyway. As I have said many times, most of the posters to this site are ridiculous.
The victimhood mentality on this board is like a college campus. This would be a 10 year lawsuit at best and cost millions in your lawyer fees.
None of you are going to get raises from a company loosing 14% revenue per quarter. Most of you are going to loose your job at Xerox. None of you are in a position to change the direction of Xerox. All of you have real world options to secure income whether another job or starting your own business.
Better to be venting here or primal screaming in the woods than bottling it up.
Such a waste of mental and emotional energy. The company spent 20 years reducing headcount and hiring few people into core (non-ACS) businesses. Face it, the average age in this company is old. So of course the age of people who are let go are older. It’s not age discrimination to let older people go out of a population of older people.
It was your choice to not go to a younger/ more vibrant organization sometime in the last 10 years. I get it, those vacation benefits are tough to give up. But you gambled, and lost them anyway. So if you’re looking for root causes for your current situation, don’t forget to check a mirror.
Harsh? Maybe. But it’s also the truth.
OWBPA - Older Worker Benefit Protection Act. A US law, includes a proviso that if you are layed off you get a report showing ages and job categories of who was affected and who wasn’t. Anyone on here layed off should have gotten one. It’s a key way to establish age discrimination claim under the law.
Please don't use acronyms that 99% of us dont know. What is OWBPA ?
