DFA final Offer

DFA forth a last and final offer. Drivers who work 4 10hr days overtime after 48 hrs only. Drivers who work 5 eight hrs day no overtime in tell after 50 hrs worked. Number 2 end all zipper clause meaning the company can do whatever it wants to. Number 3 company 401k end all pensions number 4 enter dean 300 health care plane. These are the top 4 but there is more and not good. I have been a shop steward at deans for 25yes and i am not a driver. But the drivers are getting k–led in this Deal as a plant worker i would never vote on this deal. As a worker they have to pay us overtime after 40. This is a very bad deal you guys need to stand strong and vote no. And if you don't work for deans you should so some class and not post on here. You will hear more tomorrow from your local unions.

Order that grants Dean Foods authority to nullify any pension benefits and all CBAs. Doesn't require it, but authorizes Dean Foods ability to do it.

And from the Teamsters themselves:

DFA not going to call off the deal if you vote No. Nor are they going to negotiate more. A No vote is a vote for Dean Foods to use their court approved power to void the whole CBA before the sale. But keep trying to convince yourself differently.

Union pension can be a trap that keeps you chained to a job forever. 401k is your money and is probably better in the long run for younger employees.

DFA is offering pension in form of a 401K, so all the "da tryin' to took ur pensions!" stuff is nonsense. And what they're offering for 401K isn't less then what the pension would cost them today. Reason they and no companies are willing to contribute to multi-employer funds is because of the risk involved- if the Teamsters do something really, really stupid and let the largest single contributor to a pension out of the pension (which they already did with UPS) then DFA ends up having to foot the bill for that stupid decision they had nothing to do with.
But don't try and use logic- just keep fighting for something for a plan that will be out of money in less than 10 years and end up with nothing.

The current pay and benefits of the union employees is unsustainable. DFA has bet $450 million that they can get out of the current CBA( which they have) and save enough to be profitable. I’m pretty sure they knew the unions will fight tooth and nail to keep the current package in place. The fact DFA went forward with the deal tells me they have a solid plan in place to get the concessions they need/want. I don’t know what plan the union has in place to protect the current pay structure but I bet they are in a tough spot. The next three weeks should be interesting.

I am non union employee. Vote with your union. The U.S. has been taking unions apart because it is better for them, not for you. If unions go we are all in trouble.

It's not reasonable for us to give up pension!!! It's all part of what we get paid. is there an offer to give us the weekly pension amount on our weekly paycheck?? Not that anyone has told us. Therefore we'd be giving up 100 or so dollars a week that the company pays to pension fund. so that should be a 2.50 hour raise to stay even !! Not giving up 100 week

OK, so actually reading this instead of relying on others:

  • If working 8 hour shifts, overtime pay won't start until after the 10th hour worked.
  • If working 10 hour shifts, overtime pay won't start until after the 12th hour worked.
  • Everything over 40 hours in a week is still paid at overtime.

Offering similar health care benefits, but wanting employees to pay a % of the cost- % wanted is much, much lower then is typical at other businesses (5% offer vs 20 to 25% that us usual).
DFA not going to contribute to pension plan other than a 401K.
Same pay rates.

DFA through Dean Foods is trying to get the locals to sign off on this, but they already have approval from the court to just void all of the CBAs if that doesn't happen. Know going from pension to 401k s—s, but no company is going to compromise on that. Therefore if you can get your head around the pension being off the table, the rest seems pretty reasonable and allows everyone to keep most of what they already have.

Think it's a misinterpretation. You can bargain for more then what the fair labor standards act calls for but not less and the fair labor standards act calls for overtime after 40 hours in a workweek. Think proposed change is no overtime after 8 or 10 hours in a day like some agreements currently call for, only overtime after 40 hours in a week.

I have always thought it was overtime after 40hrs. I know that's the way by law for the normal none drivers/ managment workers but with Dot laws maybe they can get away with it. sounds like DFA is trying to screw this guys big time.

Time for all you union guys to tell DFA take it and shove it. No way 44 milk plants close it would cause a melt down from the framers going under to a major milk crises in the country with everything going on right now. It's time for workers to take a stand.
