All you have to do is file for workman comp for ear infection. Because if not cleaned properly earbuds can cause ear infections look it up and then the doctor will give you a note stating that you can't wear it problem solved
Employees get so hung up on policies.
Policy only says what can't be done or must be done. If a manager wants to add something they can as long as it does not violate policy.
Also, stuff can always fall into a vague policy. Your job description has the line "other tasks as assigned" specifically to be vague and cover anything a manager may assign to you. So any time someone says "that's not my job" a manager always quotes that line.
So in short, if the store says they want you to wear ear pieces, you have to wear ear pieces. There is no policy that says they can't make you and there never will be unless some law passes making it illegal, which there never will be either.
