Vengeance options

Employees and ex-employees have a surprising amount of power against the company along a few different paths. Here are some. Looking for others. Also if revenge isn’t your cup of tea perhaps doing the right ethical thing is.

  1. Report malfeasance to the press
  2. Report it to the SEC. For a great read on how this has happened in the past at Xerox, who is no stranger to book cooking: https://www.wsj.com/articles/SB993674133642973302
  3. Participate in investor chat forums such as Yahoo finance, let your opinion on the company be known- be sure to include your relationship (current, retired, etc)
  4. File a complaint with your state anti-discrimination agency. Age discrimination has been clearly involved in recent IRIF actions. Same for EEOC. Both have a time limit to report and is most effective if you do so prior to signing any release. However the release does not prevent you or penalize from filing a complaint which is different that a lawsuit.
  5. Keep the media informed by going on record. I’ve found local press not very willing to run stories based on reputable sources unless a name can be printed.

I’m with OP too. Take action that exposes the mgmt team to inflict damage to their reputations as qualified leaders. Otherwise they will potentially continue to inflict damage on future employees.

Siding with OP, and realizing many of those laid off will have nothing but time on their hands. Many will be too old (60+) to find employment in their local area, and too old to want to relocate or take a lesser job.

Not right and not legal are completely different things. Vengeance is a losing plan. Even if you were to “win” something after years of legal battles, the lawyers get a big chunk the cash and you made yourself unemployable. And the senior staff are still multi millionaires. Much more productive to move forward in a positive manner. People change jobs all of the time. Many of the people who focus on vengeance or the pathetic “am I safe?” had nothing to offer in the first place and are beginning to realize XRX skills are not always marketable, no matter how important you thought you were.

Hi executive team!

Age discrimination can be easily proven simply by providing the EEOC or your state anti-discrimination body with the federally mandated report that is provided to those laid off. Many of the layoffs in 2017-2019 show age bias clearly in these reports.

Regarding the team just trying to figure it out:

  1. Stating a strategic plan for revenue growth to investors that does not exist isn’t right.
  1. Manipulating results through accounting tricks is not right.
  1. Changing severance olive silently immediately prior to lay-off is not right.
  1. Failure to report the extent of layoffs to new media is not right.
  1. Use of “the left drawer” and claiming revenue for shipping product to warehouses is not right.
  1. Hiding staff reductions via outsourcing is not right.
  1. Signing contacts to personally benefit executives and not Xerox is not right
  1. Refusing to re-hireemployees who took pension or 401k withdrawal: not right
  1. Implying jobs may exist in Cary when only 40 are available for Monroe County persons is not right.
  1. Manipulation of XRX technical inputs to bolster EPS artificially may be standard practice to you, but when the future revenue picture is a pipe dream, investors will get screwed. Not right.
  1. Carl Icahn: Not right.

OP was advocating to do the right thing, whatever that might be. You are suggesting doing nothing is the right thing. I disagree.

Also, nobody cares about age discrimination. It exists, is impossible to prove, you will not changes that, so move on and make another plan.

The stupidity of the original post is indicative of the attitude of many lifers within XRX. The business is disappearing and the EC is merely keeping the staff size in line with what’s left. It s—s, no doubt, but this is the reality of the situation. Do the new guys have all the answers? Any answers? Maybe not, but who does?

If you are considering becoming a whistleblower as the OP advocates, there are some things that you should keep in mind:
1) Is what you’re reporting truly illegal? It may be immoral & not in the best interest of the company or its customers but that doesn’t make it illegal. An argument could be made that even if it puts the company in jeopardy in the long term, it’s in the best interest of the stockholders in the short term if it increases share price.
2) Do you actually have proof of illegal activities? Without proof it’s just he said/she said.
3) Does the company have a reasonable defense? I may have been laid off due to my age, but there is also a reasonable explanation for eliminating my job. I wouldn’t win an age discrimination suit.
4) How will this impact your future employability? While there are laws in place to protect whistleblowers, there is no law that can make another firm hire them. Companies are often leery of hiring someone who disclosed malfeasance or sued a previous employer.

I would not wish to discourage someone with a legitimate issue. However, I do believe that this type of decision should be carefully considered including potential ramifications and your ability to provide sufficient proof of illegal activities to make those consequences worth risking.

I am shocked at the response from @mxd
Everyone is entitled to take action or “move on” but everyone owns the responsibility of doing what’s right.
I can’t imagine turning my head and just going to another job without the thought of how many people have been affected and then shrug it off.
Understanding right from wrong is vital to society and allowing these clowns to make decisions based on greed is just plain wrong.
I highly doubt that a legal team has vetted completely all that has been done but instead I would believe they have a team of risk analysts that can tell them how many people are willing to take action and how many will walk away without a fight.
I’m sure they can also tell them the probable cost factor and how many can even pursue actions based on cost.
With the reactions I see on this site about “ get over it and move on” , my guess is the whole sequence of “fight or flight” is something the Xerox team banks highly on as the more “move on” they see, the safer they feel.
I choose to follow the thought pattern of the OP.
I can move on and I am not even at extreme risk at this point but I’ve seen too much questionable decision and not from those that even have the legal power to do so as it stands right now.
So with that, I say challenge it all

It's a business making business decisions. We all think their bad and just trying to make short term gains to either sell their stock or sell the company. I'm pretty sure Xerox has a legal team that has both vetted their decisions to ensure they have some defense and that are willing to reach out to those who speak out to protect their brand. Either way way to costly to try and keep my average salary.

If you don't like the direction they are going then look for work. You have gained experience and got paid for it. So now go use that knowledge somewhere else.
