The Rmoving of the Sales Specialist allowance

Please lookup up the memo written by Ricky Dameron dated 12/6/2012. This allowance was not a Spiff or Commission. According to him this allowance will become a ready and dependable income,not subject to fluctuations or variability based on spiffs. Employees will be able to retain this pay Allowance as long as they stay hourly and stay employed. So if anyone out there wants to contact a legal team this is a reference point. With my 20 years at Lowe's I have never seen a company in such turmoil. Lowe's does not get the fact that happy employees produce better. Taking peoples jobs away and pushing good people out is not the answer. The concern should be for the employees and their concern should be for the customer. Marvin needs to go back and research the values that his parents tried to teach him. Do I here a God Bless. I hope some pursues this.

Do the specialists really think they are immune from cutbacks and somehow Lowe's attorneys are not familiar with the law? Corporations have been cutting jobs, benefits, and wages for years, but Lowe's specialists think the law excludes them from the economic forces and corporate decisions that have screwed almost every other worker in America.

I hate to say it but specialist will be removed by end of year so be smart and use this time up wisely to find a comparable job elsewhere at least they gave you time to adjust which is better than most get.

The policy of the allowance does not die when the old CEO and RVP's retire you mor0nic D0uchebags. This is not Game of Thrones FFS. The policy was made it gave specific reference to the length of time the allowance would be allowed. That time frame was/is totally depended on your type of position(hourly) and that you remain in that type of position. So this is a breach of a policy they set up in what was good faith from their best selling employees they just screwed over. Trust me lawyers are already hard at work on this. As for you smug under $10 an hour worker bees get back to licking the SM's b-hole.

Just looked it up to be sure I was referring to the correct law. Section 406 of the Sarbannes Oxley act requires officers of publicly traded companies to act honestly and ethically. Rick Damron's actions survive his retirement.

Some lawyer will have fun with the fact that Rick Damron was a member of senior management, and therefore, an officer of the corporation. Last I heard, officers of publicly-traded companies had to follow the Sarbannes-Oxley act to the letter. I believe this includes promises made, contracts signed on behalf of the owners (shareholders) of the company. Should be interesting.

I don’t agree. There was nothing in the language of the agreement we signed stating it would be null and void In a future regime or that it had a time limit. I think their lawyers have left the door open for a class action lawsuit and I do believe it could be won. If we stick around long enough I believe we will be able to get a settlement

In an ‘employment at will’ state, the company can end the employment agreement at any time and for any reason.

One problem with your logic, regime change has nothing to do with the law, as ownership of the company has not changed. That being said, it will be interesting to see how this plays out in court, especially for those that live in an "at will" state.
