For years- since he purchased Sears- Eddie Lampoon talked of the plan to build an e-commerce business that would more than offset the sales losses from brick and mortar stores. He was “allegedly” withholding capital funds for stores to invest in this web endeavor. Of course, the websites became obsolete and Eddie got
richer. There never was an e-commerce plan to exploit the consumer purchasing behavioral shift.

Hey Montgomery Wards still lives on as a website, Swiss Colony (remember them the cheese and sausage kiosk in the mall around the holidays) now ow es and operates wards.com. Sears faces a similar fate

Even one of their site hosts has an outstanding claim; but here's a few short quotes from a different claimant; Docket 5056; Normally Sears would ONLY capture a commission from web sales; but in this case; and many others; the vendor was not even paid for their own cost of goods since Sears was in complete control of transactions for web sales!

AMI filed Proof of Claim No. 8514, in the amount of $108,015.38 asserting that the claim is entitled to administrative priority pursuant to 11 U.S.C. 503(b)(9) (Claim No. 8514), arising out of the Claimants’ sale of goods on Sears.com and affiliate sites to Sears’ customers. Sears directed Claimants to send goods directly to the customers for which Sears had collected payment. These goods were delivered to the customers 20 days prior to the Petition Date, but Sears never remitted customer funds to the Claimants.

Once Transform purchased the 425 Sears stores, the Claimants continued to sell goods to Sears.

Sears provided the Claimants with access to Sears and affiliate websites as a platform to post merchandise listings and facilitate the sale of Sellers' merchandise to users of the Sears websites. Through third-party marketplace e-sellers, Sears wanted to expand their product selection for their customers beyond what they carried online and in-store. They provided software and support to list the items to offer to Sears customers. Sears would charge Claimants the monthly fee and commission on each sale going to Sears customers.

Sears has not taken any responsibility for remitting any taxes in 2018 on behalf of customers transactions.

Sears account manager for the Claimants made several misleading representations to the Claimants about the unpaid pre-petition Claims, the sale to Transform, and the unpaid Straddle payment. AMI Ventures, Inc. was asked to execute new agreements with Transform and duly did so, unaware of a Claimants’ right in bankruptcy to obtain cure payments if an executory contract is assumed and assigned.

Thus, given this Claims Objection it is now the Debtors and/or Transform’s position that the Claimants have neither an Allowed Administrative Claims or a right to cure payments as an assumed contract.

Pretty much. I've had managers tell me to just pack whatever looks close enough, accuracy be damned. It's all about FILL RATE FILL RATE FILL RATE!!!!? (that's a spoof of the typical email from a former DM sharing a name with a bard) I've seen so much stuff that had to be purchased from a grocery store across town to fill orders, costing significantly more than the customer even paid. Managers having to drive an hour to another store to pick up something was also a frequent occurrence. But basically, the fill rate was god and as long as that was good enough, it was the customer's problem if they got the wrong item.

Stores are under pressure to meet their goals for .com orders. We cannot say no to a .com. So we will send you pretty much anything if we don't have what you ordered, so many dissatisfied customers!!!

I was looking for a coat and only one coat on the sears website actually comes from sears
All the rest of the coats come from misc people listing their items on the sears site

Sears,com should be renamed sears eBay

No! I have ordered online during the holidays last year. Half of the time I did not receive the item ordered - wrong size or some random item. Other friends and family have the same experience. Will never order online again.

In order for Sears.com to survive, warehouses to stock product would need to survive as well....No more stores to pull .com orders from if the stores go away.

Yes. Montgomery Ward still lives on the web. Its not the “real” Wards, but someone who bought the trademarks and operates as though it never fully kicked the bucket.

Put some of those animated spinning view count (I especially like the ones that make it look like it's burning out and the wheels are coming off) and "Under Construction" sawhorse gifs and we can make them look like they were straight out of the 90s...like the stores.
