Who plans on negotiating their severance package? Any success with this? Does an attorney in labor laws help? Some lawyers specialize in negotiating severance any thoughts? Let’s get em boys... help each other out!

I have not signed my severance and turned it back in yet, and I'm not going to anytime soon. I'm in talks with someone and was advised not to. I have 45 days to turn the signed severance in or I forfeit it. But I'll be damned if I'm going to sign something that releases this company from the piss poor way they went about the terminating and hiring of staff this time around. I have investigations going on and will wait on the results. Then, and only then, will I sign this crap piece of paper for my blood money.

Lol......loser alert......you work in retail......big salary you must collect lol. Bussiness is in the dumpster so when there is no profits you must be let go. But then again hard for a retail worker to understand ,We are not talking about dr...lawyers or teachers lol

You all are idiots! They offer a severance as a pay off to get you to sign legal documents. These documents contain things such as... you won’t sue or join a class action suit against Macys. What could you sue for, possibly they did something on purpose or by accident that did not follow the law in regards to the dismissal. There could be non compete written. They could put in that you won’t speak about Macys or being laid off and if you do they can sue YOU for slander. Talk to ANY labor law lawyer (employment lawyer) and they will tell you it is negotiable. They are not out of the kindness of their hearts giving you severance because they are an outstanding company. Like I said YOU ARE an IDIOT if you you think they have nothing to gain. Negotiate and get what your worth people...

And hourly associates may not but all the salaries managers DO have a leg to stand on in regards to negotiating a better severance like 2 weeks for each year instead of 1 which is a bunch of bull.

Well I doubt hourly associates have negotiating power. Maybe salaried executives do. Don’t push it because companies are not legally required to provide any severance whatsoever. It’s a sinking ship. Take the severance and move on before we are all let go with no warning like Sam’s Club.

Ok, here is one... they might be implying on negotiating for equal package as directors and higher executives who received 2 weeks for every year of service. SMs only get 1 week.

I’m still waiting for someone to share what you want to “negotiate” ? Your job is GONE. There is not a position for you. The company is offering some kind of compensation including COBRA payment for three months, outplacement services, and a week of pay for each year you worked there. What are you wanting to negotiate, you want them to make a job for you? Bump someone else? Double your package? Come on posters, don’t hit and run this thread. Explain yourselves.

The severance agreements I’ve dealt with for the company....for those aged over 40 there’s a revocation period which means after you’ve signed, you have x number of days (I believe it’s 45 days) to change your mind. I would assume this also applies with a layoff.

I was let go and I am with MST. We are not union and we have many age 40 or older. Almost 3/4 of the team is older. We were called and released the day of the call. I had 39 years with the company. Some older guys with less years were not let go. Not certain how this worked. We all had to sign a waiver several years back that stated we could be let go by the company without just cause. We can be terminated without a reason. If you did not sign it, you were not employed. So there you have it folks. They can sever you without notice and without a reason. You can not sue, so sign the package.

I can tell you our situation in my store...we are laying off about 30 sales people. It’s awful having all these conversations and I’m losing good people. Of the 30, over half are under 40 and of the other half no one is over 65. It’s almost all pure seniority except in the commission departments and even there the scoring is heavy on seniority and with those, they are about half and half over/under 40. Why are you continuing to insist it’s all about ageism ? This seniority method benefits the long term associates! If they did everyone on scoring then the whole thing could be suspect when these people started getting laid off first. The sales manager reduction last year was a completely different thing and yes there were older managers who were not performing who were let go over younger ones. I was very concerned last year but I made it and yes I’m over 40. Many of our cuts this time around are part timers working second jobs or in school or working weekends only in those short hour jobs which are all going away. There are full timers going away and those are the hardest to talk to but there’s no way it was done by age. Last In, First Out.

The one question is still whether or not Macys is obligated to follow the OWBPA (Older Workers Benefits Protection Act). I keep hearing we must sign the severance agreement in 7 days. For those over 40 I am not sure that is true. anyone?

Hahaha okay don’t try to negotiate however severance is always negotiable. The documents your are signing limits liability for you to sue the company down the road. Why do you think you are signing off on them. So even if discrimination of any kind is found on why someone got laid off and did not get a job you can’t sue due to signing the paperwork. Before you sign any type of paperwork you should always consult and run it pass a lawyer. I’m am telling you if you two are laid off make sure to speak to someone before you sign that paperwork!

They are set, fair and consistent. You can contest or negotiate. It’s a policy applied to all. They don’t owe you anything, some companies close up and you are gone.
